Stamp4 EUFAM to Stamp4 based on Parent of Irish citizen child

hi All.

To make it short, My spouse has applied EU3 previously and got refusal letter on December 2022 But her IRP card was still valid till 30/03/2023.
we have Irish Citizen Child,
So We went to local immigration office to apply permission to reside based on Parent of Irish Citizen Child but immigration officer says that he needs letter from EU Treaty right section that person is changing permission to stamp4 parent of Irish citizen child.
I explained to the man we still has permission until end of march 2023 and in the law says
if person had visa previously then just head to local immigration office to get permission.
but he wants official letter from actual person refused our case but I m no longer reachable to that person.
also he checked and told us that my spouse IRP Card was cancelled now, I was so shocked, when, how, we have not informed
just wondering when eu3 application refuses then current IRP card also cancels?
anyone had similar issue?

Now our only bet is to apply by post to UNIT4 SECTION, because man says her IRP cancelled

She cannot have her stamp ‘downgraded’ without approval - once she gets a Stamp 4EUFAM, she cannot just go back and says she wants a Stamp 4 as that would be a ‘downgrade’. Such cases can only be for ‘upgrades’. (E.g. if she was on Stamp 3 and wanted to change to Stamp 4 based on having an Irish child.)

The department cannot revoke her permission without a letter. What was the reason of refusal? If you didn’t receive one, it might have been sent to your solicitor? I remember you mentioned you paid 6k to a solicitor in a previous post a while ago.

Definitely you that posted about paying a solicitor on 10th May 2022 we do look at previous posts you know.

Confirmed you can’t get stamp 4 eufam
To stamp 4 on the basis of irish child?
Do you have any official source?

Nobody said you can't. You just need explicit letter of approval from ISD allowing you to do this, as they don't process "downgrades" (changes from better stamp to one that is worse) routinely.

But if
Circumstances changes like in this
Situation his eu3 was rejected so he has another option
Or
My eufam partner is away
For long term so he knows he will
Be rejected eu3 so better to play safe side
And change stamp
On irish based child.

How to get the letter from
Inis to get the stamp4??

Ask for it from ISD. When received, attach to online renewal form.

From personal experience, tried to downgrade (different circumstances, from stamp 4 to a different stamp) via online form, got denied saying I need permission from ISD. I sent a letter to ISD by post, explaining my situation in a cover letter and with copies of all the documents. Got a response in quite short period of time saying "due to your circumstances, you're approved to switch to Stamp X"; attached this to online renewal and that worked out.

Nothing to say besides what was already mentioned.
Had to change stamp (4 to lower), put it through online renewal. Got denied. Sent a letter to unit that deals with new permissions by post, got a response in ~2 weeks saying "in your case and due to your circumstances Minister grants you *new permission* ". Enclosed this and the rest of documents into online renewal system, it got through.

I hold a Stamp 4 EU Treaty right, based on my child British, which expired on March 12, 2023. Therefore, I went to the Garda to get it renewed or changed to Stamp 4 based on my Irish child (my child obtained Irish citizenship 2 years ago). However, they refused and told me that they needed an official letter from the Department of Justice. Instead, they advised me to send an application to Residence Unit 4. I applied on Feb 24 and received an acknowledgement letter on March 1. On March 7, my permission based on the parentage of an Irish citizen was granted for three years. Hope it helps

Response yet been 2 months ,
Just a quick one after 3 years of expiry of stamp 4 you have to apply again or extend again for 2 years or it will be extended automatically?

It's never automatic, you do need to apply.
