Joint H/W Naturalisation - both on ILR

Post by truthparrot » Sun Aug 02, 2015 2:31 pm

Hi. Does anyone know about this:
If I have ILR and been resident for more than 5 years and my wife has ILR and is resident for 3 years, can we make a joint husband and wife application? The 3 year requirement is only for someone married to a British Citizen. I am not a BC at the time of applying, but providing my BC application succeeds, would my wife then qualify under the 3 year residence path as she would then be married to a BC?

Not sure if there is a policy for such matters. I suppose technically if wife's application decided before mine then she would fail the residence test (!)

If anyone can shed light would be much appreciated.

The concession for joint BC applications has been withdrawn. You will now have to make separate applications, each with the relevant documents and pay two fees. As soon as your application is approved, your wife would be able to apply as the spouse of a BC, assuming she meets all the standard requirements.

Just to clarify Casa's excellent advice, your spouse can apply once you have attended your ceremony and received your certificate. This is separate to the approval letter you receive.
