Living together in an EU country, want to return to the UK

Hi!

I've read the family visa pages about a million times now. Please see the situation below.

My British partner and I are currently living in the Czech Republic and working here. We would like to return to the UK together (I lived there between September 2015 - June 2018), he's, of course, British. The minimum income requirement requires him to be working for at least 6 months. However, he is currently living and working in Czechia with me. Does that mean that he would have to leave, work for at least 6 months, then be able to sponsor me?

The page says that if we do not meet the income requirement, I would be able to settle in 10 years instead. Does that mean the visa can still be granted even without the proof of income? So confused.

Is there absolutely no way we can return together at the same time? He would find a job prior to the move, but that's probably not relevant.

When did your British partner move to the Czech Republic/Czechia? Are you married or unmarried partners?

Hi,

I visited him in the UK in September 2020, we moved to Czechia together in October 2020. We have been living here since then, both employed.

Edit: Sorry, forgot to mention we are not married at the moment. Does marriage affect any of the requirements?

Hi,

Yes, it indeed is his post, but it doesn't cover the financial part. We want to try the EU Settlement route first (though I can't find a way to apply, we must contact them first via phone, the email response was just a template).

As your partner was already advised, you don't qualify to use the EU settlement route.

As per the gov site, COVID is mentioned under one of the reasonable grounds for late applications. But if you are certain an application like this will be rejected, we might abandon the idea and choose the family permit. In that case, I revert to my original question - the financial requirements and meeting them when we are currently both living in another country.
