Long Residence ILR family Application

Post by Puki61 » Mon Feb 15, 2021 6:06 pm

hi there,

I hope someone would help me and explain the process i should be doing.

My entry date is 11.04.2011 with TIER 2 INTRA COMPANY VISA , my wife joined me 2015 and she is on TIER 2 INTRA-Company dependant visa as well.

Our existing VISA extention expire date is 15.05.2021 , however I could apply for ILR by 14.03.2021 for myself
(28 day prior to the entry date )

so my question is relates my wife , i do not know procedure for her.

Should I first apply my ILR and after getting the settlement i will be applying a new different visa for my wife or should i apply a different type of visa at the same time of ILR application for my wife as well ?

IF yes what visa I need to apply along with my ILR application ?

should be both applied in the same application or separately ?

Please kindly help me as I do not know what to do , starting to fill the form my ILR application form currently.

Regards
Burak

Long residence can only be applied by you as there is no concept of a dependant. Your wife must apply separately and before her visa expiry to switch to the family route using form FLR(M). Her visa will only be granted after your ILR is approved. Note that the 5 year family route has English language and income requirement

Thanks letting me know , what would happen if i do not get ILR before her visa expires ? I will apply 15.03.2021, but the visa expire date is 15.05.2021, so we have 2 months allowance between.

She must apply before visa expiry regardless. Her application will be held until your ILR is decided

Thanks for the details, I assume 28 days rule does not apply for my wife ,so after the ILR application i could apply for her sometime later after my application.

My application would be on 14.03.2020 , and wife's application i can apply on 25.03.2020 or a later date regardless her expire date?

She can apply any time after you have applied and she must apply before her current visa expires, as has already been advised.
