Marriage breakdown

Post by Poppy1820 » Sat Dec 22, 2018 1:15 am

Hi!
Im hoping for some direction - who do I notify & is it worth my effort.
Im UK citizen, my husband is non UK. His first spouse visa ended in the summer. Our marriage ended at the same time. He applied and received a parent visa (we have a 2 year old). He failed to support our child financially, missing several months of agreed support or paying less than agreed. After 6 months and his 'bite me' attitude i had to go to CSA. He also didnt want to be active in our childs life. He went to a solicitor to state he could only commit to 2 hours a week access despite me giving free access with the caveat that we worked out a week in advance timetable (both of these issues were already key in the marriage ending).
I have now come into information that hes actively seeking employment outwith the UK, using his parent visa.
Is he in breach of his visa?
Who do i advise?
Will HO care anyway?

Thanks

Not sure what you mean by 'outwith'??

If he holds an FLR(FP) parent visa, he is permitted to work in the UK. Why do you think this might not be the case??

Outside the UK.

In some areas (Up North), "without" (and "outwith") are the antonym of "within".

Also see this tweet about the word "outwith".

To the OP, an FLR(FP) visa only gives him the right to work in the UK itself, not in the rest of the EU if that is what you are implying. If that is not what you meant, can you expand on how he is attempting to "actively seeking employment outwith the UK"?

Thanks for the replies.

Yes 'outwith' in the context means outside.

I have no problems with him leaving the UK to seek employment (he has a good job here already) except for the fact it is extremely unlikely he'll support

Ive not been clear.

The fact hes not adequately financially supported his child so far. The fact hes seeking employment outside the UK and the fact he does not physically see his child - does this not point to him obtaining a parent visa under false pretence?

If he leaves the UK, the financial contribution hes just started to pay via CSA will stop. Will this effect the validity of his visa?
