Married with a British citizen - time spent in UK requirements

Post by Sebgn » Wed Apr 10, 2019 2:17 pm

Hi.
I'm married to a British citizen and thinking of applying for citizenship myself. One of the requirements is:

- have lived in the UK for at least 3 years before the date of your application

We met as I was a student living in the UK (Tier 4 visa). Doses this time counts towards the requirements?

Thanks

And the mandatory requirement of holding ILR. You don't appear to be holding ILR as you posted on 2nd April 2019 that you hold a Tier 1 Grad Ent visa. How did you manage to marry so quickly after only asking a week ago what to do to get married???

It is NOT about being with a British citizen or married to one for the full 3 years. It is about being married to a BC at the time of applying for your citizenship, even if your spouse only became a BC the day before you apply.

:D
Yes sorry, since I was on a different post and different topic I didn't want to explain the whole situation. I'm still Tier 1 GE and we are getting everything ready to get married (Registry and all). It's just that I could ask for an extension of T1GE or see if we should ask for a leave to remain based on our relationship. She asked if I could ask for citizenship, but I wasn't sure hence I asked here :)
So, if I get married this year and ask for a ILR, when could I ask for citizenship... Would my years as an student count as part of these 3 years requirement?
Thanks for the your promptly replies!
S.

You need ILR first. Not sure how long you have lived in the UK or what route you plan to take to ILR.
So, if I get married this year and ask for a ILR,
You cannot 'ask' for ILR. You have to apply and pay the large fee IF you meet the requirements. Not sure what your full UK immigration history, as you don't state this. Simply marry a British citizen does NOT give you any automatic rights for Immigration purposes.
when could I ask for citizenship...
Again, you don't 'ask' for citizenship. You have to APPLY and pay the fees when you qualify.
Would my years as an student count as part of these 3 years requirement?

Read my answer I have given above. I clearly stated it is being married to a BC at the time YOU apply. Nationality law says that this route under Section 6(2) of the nationality is based on 3 years residence. It does not state that it MUST be 3 years married to a British citizen. You simply need to meet the residence requirement, which is a separate requirement regardless of what visas you have held.

I might have not been clear. When I say ask I meant apply.
If I understand correctly I can apply for a family visa to stay with my partner (after we get married), and then I would apply for ILR. Right?
The rest is just a question my partner asked and at the moment I don't need to know anyway.
Thanks

Yes, you can apply for a spouse visa on form FLR(M) if you meet the English and Financial requirments (£18,600pa income). You would need 5 years on this visa route (2 x 2.5 year visas) before you can apply for ILR based on 5 years residence.

If you have been in the UK for 10 years with legal stay at some point, you can also apply for ILR based on 10 years long residence if you meet the requirements.
