MN1 application

Dear guys,

I've some questions about MN1 application, section 1(3) [child born in UK and parent got ILR].
Section 2 of the application asks for child's date of first arrival to the UK. The child is born in UK, should it be left blank?

Child's absences from UK. Actually, the child got his (foreign) passport five years ago. Before that he used to travel via his mother's passport which expired 5 years ago as well. Should I list the absences since his birth or since he got his own passport?

The family has to travel few weeks after submission MN1 using NCS. Should I enclose a self-addressed "international signed mail" envelop? Or no need just to let the Home Office know about change of address before travelling? My concern here is the mail service in the Middle East and I guess that the HO will send the certificate by standard mail.

3) How will you enrol biometrics;
&/or respond to any follow up questions?

4) How long are you going away for? are you coming back? (application may take months)

Actually, I have to be away for few months. I thought e-mail should be a valid medium of communication and I read on the forum that Biometrics could be taken abroad.

Apply in UK, enrol biometrics in UK.

HO are old school and operate by correspondence.

Suggest review priorities and/or delay the application. Why the rush anyway?.

The rush because the kid's visa expires in a month. I don't know how will it work. I cannot postpone my travel plans and it seems there are lots of complications if it's done abroad.

A UK born child does not require a valid visa to apply for citizenship.

Yes, but the family will be abroad when the visa expires. How can the child enter the UK without a valid visa?

HO is not going to work around your travel plans.

Suggest review priorities and/or delay the minor's application and/or alter travel plans and/or leave child with trusted relative.
All are more possible than HO fast-tracking your case because you have to travel.

You will have to apply for ILE for the child.

Citizenship can take a few months. Applying for a passport from abroad can also take 6-12 months as they are processed in the UK not at the embassies anymore.

When you say 'away for a few months', how long exactly will you be away? Does your spouse have ILR too?

My wife doesn't have ILR at the moment. Not sure about the period I'll be away as it depends on some family issues back home and it may take more than 6 months.

What is your wife's current visa status?

On what basis did you obtain ILR (5 years residence PBS or 10 years long residence)?

My wife has a student visa [tier 4]. My ILR is based on long residence [10 years].

Who is the child's visa dependent on, you or your spouse?

Your spouse will need a new spouse visa to come back to the UK and will then have to wait 5 years to apply for ILR.

The child is dependent on my spouse.

You won't get MN1 in a short time frame and you are only complicating things by trying to 'rush' it. The child can apply at any time, so suggest apply when you return to the UK.

They will need settlement visas to return to the UK and will have to meet the financial requirement for this. Or student visa if your spouse qualifies for one again.

Suggest child registers via NSC before leaving the UK.

A British child may return to the UK more easier and your wife wouldn't be subject to the extra financial burden relating to a non-settled or non British child when applying for a settlement spouse visa.
