MN1 Form and Overstay

Hi there,

I have applied for my daughter MN1 British citizenship application as she was born in the UK and I now have ILR. She is currently on a visa which will expire soon. From what I understand if her visa expires before the MN1 is decided she will technically become an overstayer though that might not affect the MN1 application itself. I am trying to work out whether there is any way to avoid her becoming an overstayer while the MN1 is pending for example by applying for another visa or whether it is not possible to apply for a new visa while an MN1 application is still in process.

If I start a new visa application it asks me "Do you currently have an application with the Home Office for leave to remain for which you have not yet received a decision?" and I am assuming if I say yes then it new visa application will replace the MN1 application?

Technically, a child born in the UK doesn't need a visa, but clearly it's useful to have one, especially for travel and proving status.

MN1 is not an immigration application, it's nationality. Any visa application you make will not cancel the MN1 application.

If you decide not to apply for another visa, it is strongly recommended you get private health insurance for your child, as they won't be eligible to use most NHS services for free.

It is no. A citizenship apllication is NOT a leave to remain application.

You don't need a visa and the overstay has no impact on the mn1 application
