Mother's family visit visa got rejected.

Post by SVG » Fri Jun 11, 2010 12:59 pm

Hi,

I am a 30 yr old IT employee working in London. I've applied INF2 (Family visit) visa for 6months for my mother on 30 April, 2010. After a month's processing it got rejected.

Me and my spouse have a collective monthly income of over 6K.

I have enclosed the following documents with the application,

my pay slips for last six months
my bank accounts of last six months
my savings account details
my spouse's company account details
My spouse's bank account details
Our house title transfer doc.
Utility bills issued on both our names

The decisoon for refusal says "I recognise taht family vsiits are imp. However, under UK immigration rules, you must show that you qualify for a visa by explaining your circumstances and plans you have for your visit. I must assess the info you have provided about yourself separately from your sponsor's part of your application.

You state that you are married and supported by your husband and son. You have not provided any evidence of thier employment or income in India. Infact, you ahve not given any eveidence of your personal and financial circumstances. I must look at all your circumstances when I assess your application for a visit visa. Without the evidence we asked for, I am not satisfied that you plan to leave UK at the end of your visit or that you are genuinely seeking entry as a visitor for a period not exceeding 6 months.

I therefore have refused your application.......... "

If I submit my brother's payslips and my fathers property details do you think I can win the appeal? Please advice me.

Sad to hear that. As the ECO has mentioned, the applicant has not provided any evidence of her cirsumstance in india.

You need to satisfy ECO that the applicant is going to leave UK after the visit and that they have enough reasons to do so. Some of the reasons could be:
- Employment (and there by regular income) in india
- Good savings
- Property
- Strong family ties

Show as much evidence as possible for each of these.

good luck with your next application.

Yes, ECO is quite right in his decision.

The onus is on applicant to prove that he/she will come back after family visit.

There is no objection at sponsor (at your side).

In order to avoid long delay in appeal i would recommend to reapply the visa and supply addtional documents like:

Marriage certificate of your mother, evidence of property owernship or shares.. (if she have any)
Bank statement of your father

Anything which could show her strong presence in her home country.

Thanks a lot for the replies, in my case the rejection is clearly due to the missing evidence ( in my hindsight it did not occur to me to send my fathers and brothers documentation), now can I appeal producing the missing documentation asking them to reconsider the decision based on the new evidence, please note that I am prepared to wait for the appeal process to go through.

Thanks a lot in advance , appreciate a quick reply
