Naturalisation for a child born outside the UK

Post by Itiswell » Tue Feb 04, 2014 3:39 pm

Hello Helpers,

I need some clarity.

Can my two children apply for naturalisation with me even when they have not spent up to 5 years in the UK?

They came to the UK 2010 and have been living here continuously since then.

I will appreciate my advice and experience.

Thanks

Thanks Vinny,

They were granted ILR same time as me.

I thought a child can apply for Naturalisation alongside the parents once the parents have ILR irrespective of the years stayed in the UK or must have stayed two years in the UK.

This is a bit confusing for me.

More help please.

Thanks

Depends on child's age. However, if they have been in the UK since 2010, then it should be okay.

Thanks Vinny,

They are 8 and 7 years old and was granted ILR alongside the parents in 2013.

Any more advice? and if possible kindly point me to UKBA document to backup claim.

Thanks

Thanks Vinny,

I called an immigration lawyer who said the children can apply for Naturalisation alongside their parents at the time as parents since they have their ILR as well as parent but if the children are applying separately then one of the parents must be British citizen.

Thanks once again.

Yes they can all apply together if they all have ILR.
