Hi. Hope you are well. I was in UK from Dec 2017 to 27 Aug 2020 on spouse visa and my BRP was expiring on 30 august 2020. Me and my husband were ready to apply for the extension of my spouse visa IELTS was booked and other supporting documents were ready. But I got emergency news of my mom critical condition and I flew in emergency to Pakistan. Later my BRP expired in Pakistan and later my husband had to travel to Pakistan to cop the situation. Later Pakistan was in red list. And we weren't able to apply for my visa. Now my husband get back to UK as Pakistan is out of red list and he want to apply for replacement of my Biomatric Residence Permit. We searched on GOV.uk website that we can apply replacement and I may get entry visa to UK and then within 3 months we have to apply for my extension that we were unable to apply last year. Need help from you guys on this topic. TIA.

You can't apply for a replacement BRP if your visa has expired.
You will have to apply for a new spouse entry clearance visa and start your 5 years from scratch again.

You will be starting a new 5 year journey on the spouse visa route.

Can I add screenshot here? How to add screenshot here. Actually I have read on the government website that if you are outside the UK then you may apply for the entry visa only but later within 3 months you have to apply for the relevant visa.

If you’re outside the UK
You cannot apply for a replacement BRP if it expires while you are outside the UK. Instead, you’ll need to apply for a ‘replacement BRP visa’, which lets you re-enter the UK once only. It costs £154.
You can apply for a replacement BRP when you return to the UK. You must do this within 3 months of its expiry unless you have a good reason, for example you were unable to return to the UK in that time.
I have copied the statement stated above from government website.. according to that condition... can I apply for the entry only as my visa got expired after I reach in Pakistan in huge emergency. I can attach visa renewal documents from 2020 as supporting documents as proof to get the entry visa only and later within 3 months apply for renewal.

Your visa expired more than a year ago and you did not make an application, even abroad, before it expired. You have to apply again for a new entry clearance visa and start your 5 years again from scratch.

That is not for your circumstances . You let your visa expire so cannot apply for a replcement as you do not hold a valid visa for the uk.
You have to apply for a new visa again, meeting all the requirements and start your 5 years from scratch again.

Hi. Hope everyone is well. Need guidance from experts My husband is going to apply for my spouse visa in this month (February 2022) and he is self employed. So what two years he has to show his income. 2020 and 2021? Or 2019 and 2020. As 2021 financial year is not ended. I need guidance on this topic. Please advice. And I need to mention that from February 2021 to October 10 2021. These six months my husband was outside UK and that country was in Red list in which he was staying. No financial proofs for that time period. Please show some guidance. TIA
