Need help with When my Dependents can apply for Naturalization?

Hi,
I need help with my situation when my wife and kids can apply for British citizenship.

> I entered the UK in Aug 2010 with ICT visa
> I was eligible for PR in 10 years route and got my ILR in Dec 2020
> My wife entered into UK in March 2011 but went back to India in May 2016 and came back June 2017 (stayed for more than an year in India)
> Now my wife and kids are on ILR dependent visa since Dec 2020 till Jul 2023
> I have not applied for my BC yet.

Now please help me if I can apply for BC for my family along with my application. They are with me since 2011 in UK with one year break in between in year 2016-17.
From 2017 they are in UK continuously without any break as dependents.

Please suggest what is best possible options i can get my dependents BC ?

Appreciate all your valuable inputs regarding my scenario. Please let me know if any additional details required.

No.

Your wife (and children, assuming that they were born outside the UK) will be eligible for ILR in June 2025. They need ILR before they can apply for British citizenship.

That one year break means that they are not eligible for ILR Long Residence. So, they are eligible for ILR either 10 years after they reentered in 2017 or five years after they started their ILR dependent visa in 2020.

It would probably be better for your wife if you already have British citizenship before she gets her ILR. If you do, she can naturalise immediately after being granted ILR. If you don't, she'd have to wait for a year after her naturalisation anyway.

You haven't mentioned your children's age. How old will they be in 2025, when they are due to get ILR along with the second/less-privileged parent (in this case, their mother/your wife)?

My children will be 17 years (born in 2008) and 9 years (born in 2016) respectively in 2025.

If your children were born abroad, they will flow the same immigration path as your spouse and require ILR before they can apply for citizenship.

The youngest child will be eligible for registration, the eldest might have to naturalise if older than 17 years and 6 months at the date of application.

What is the 17 years and 6 months rule?
I always thought children can be registered as long as they are below the age of 18?
AFAK If a child applying for MN1 registration turns 18 during the process they will still be registered but will have to attend a ceremony (on payment of £80).

You're right I think if someone is 17 and 6 months you need to provide details of a council to do the ceremony in the application, my bad.

No, you don't. There is no option for this in form MN1. Applicants who turn 18 during the process are contacted by ukvi.

Just one more question please. What is the application I need to fill in for Naturalization? Is it easy process or I need to go through some experts support to apply for the naturalization? What are the documents required for the naturalization application please? Appreciate your response.

People mostly do it themselves if there's no extreme complications. Not easy, but shouldn't be immensely challenging.

The documents you generally will need are: all passports that cover the qualifying period, life in the UK test and language test (for adults), proof of ILR, 2 referees.

- note that it's a relatively straightforward application, normally one doesn't need professional help with it. Also note it's not an immigration application but under the British Nationality Act - your ILR continues until you are British, after the ceremony, and after applying you can travel without restrictions.
- the main difference to immigration applications is there are no financial requirements - naturalisation is mainly concerned with residency requirements, absences from the UK, good character, referee declarations and whether you are proficient in English and knowledge about the UK.

I have NARIC English Language Certificate & Statement of Comparability are awarded in June 2020. Also around the same time I have got Life in UK certificate also.

Please let me know if all these certificates are still valid for my Naturalization application.

Those will be OK. Make sure you have reference numbers for both
