New Point Based Visa - Jan 2021

Hello,

I have few queries on the New Point Based Visa, Which the govt has announced and which will be going to start from Jan 2021, but I wonder due to the COVID situation will there be any impact on it I mean any chances of postponement? or will that be in place as per the announcement?

Another query is can I apply from with in the country? If I am eligible for that will my current stay in the UK get reset for ILR? I mean do I need to stay for 5more years to get the ILR?

If this is in place and going to start from Jan, from when they start taking the applications?

Hello I am on Tier 1 General (Dependent) and my visa end by Feb 2021, by then i will compelete 4 years. But i don't have any source of extension from my partner.

Why can't you extend your current visa??

What is your UK immigration history?

What is your partners current UK immigration Status?

Which new Points based visa particularly are you asking about?? The new PSW visa, which still has no rules or guidance, is only available to Tier 4 students and not to any PBS Dependents.

Any other points based visa will likely remain the same, ie Tier 2 etc and you have to apply from home country and have a sponsor.

I and my partner are not in good terms and I don't have an option from him at this stage. He is British now and I am working even my employer provides sponsorship.

The visa you are referring to is the current Tier 2 General visa, which has no plans to be changed other than perhaps a few tweaks to the existing visa rules. The link you posted addresses mainly the issues for EU citizens once we leave the EU and the transition period ends and how they can come to the UK in the future.

For tier 2, you still need a sponsoring employer and you must meet the requirements and points.

What is the current job that you do?

So if you split from your partner, you could apply for FLR(FP) parent route based on your child.

Do YOu mean the family visa? For this do, we need to Divorce?

Also, my concern my stay in UK gets reset and again i need to start fresh for my ILR. That's the only concern.

You need to be separated at least and not living in the same place.

Even changing to the PBS route you posted would reset your clock to zero and a new 5 year route. There is no other way to maintain your last 4 years unless you remain as a tier 1 dependent and then apply for ILR when you qualify.

If you are going to go the flr fp route, I suggest you read up on the visa. It is not the easiest visa to get and has a fairly high refusal rate.

If your employer is a tier 2 sponsor they can sponsor you but you have to apply from your home country.

Any route you choose to go in other than your current route, resets your 5 year clock for ilr and you start again from scratch.

Yes, you need 5 years on tier 2 before you can apply for ilr and you are tied to only one employer and must meet the salary requirements for the SOC.

You cannot combine PBS dependent time with main tier 2 time to make up 5 years for ilr.
