Hi

I am an Indian Passport holder on a work permit in Australia. My girlfriend is here with me on a defacto spouse visa. I know that there is no "defacto spouse" visa for the UK, but is it possible for me to get her a spouse visa (after I get my UK Work Permit)on the grounds that we were living together in Australia, and intend to relocate to the UK together?

There is a "DEFACTO Visa" in the UK.

Yep I've seen that before. But am I considered as a person "settled" in the UK, if I am on a Work Permit?

They treat all immigration categories that lead to settlement (other than by the long term concession) as if you are settled for that purpose.

There's a slight misunderstanding here. You must be legally unable to marry in order to qualify. From http://www.ind.homeoffice.gov.uk/default.asp?PageId=1056 : "A common law partner will not qualify unless they are legally unable to marry. The fact that the couple may choose not to marry is not sufficient to qualify."

If you don't meet this requirement, your girlfriend could only come with you to the UK on a fiancée visa, spouse visa if you get married beforehand, or through her own means.

The catch word is "LEGALLY unable to marry," not including age reasons...meaning:

You have to be a gay couple
OR your still husband/wife has to have vanished and you can't get a divorce OR divorce is illegal in your country.

EuroCitizen is partially right. Being married to a 3rd person is enough for the "legally unable to marry" requirement. Once again, go to the link I gave you above and READ it. All the info is in there.
