Did not actively intend to be illegal/ circumvent the immigration rules by delaying removal proceedings, conducting a marriage of convenience etc - I don't know how you prove this!! 2. No criminal record - Crucial. Go to Home Office link below for more details - I suggest you get good legal advice (might be expensive) http://194.203.40.90/default.asp?PageId=752 If the HO accept your reasons you get Indefinite Leave To Remain. Conditions pertaining to citizenship require legal stay in the country for a minimum qualifying period of 3 years if married to a UK citizen and 5 years if not so you will have to accumulate the pre-requisite legal stay before making the application - focus on the ILR first!!!
