You are assuming the WP in question is for a change of employment .

Based on the information provided by the poster to whom I have replied in bullet point/ numbered format (I beleive its bhavna) it would appear that her application is a new application rather than a change of employment. It seems like she will get a new job and thus WP after she has already left the country! I also deduce by virtue that she has been made/ is likely to be made redundant it is unlikely that her occupation is in the Tier 1 category hence by default it is in Tier 2.

It depends what her excact details are and since she has not provided them I have in my advise erred on the side of caution. Elementary my dear Watson .

Dear Holmes,

I, actually, understood it a little bit differently - I thought that she (or he?) wanted to come back to the country using her (or his?) old permit and visa and apply for a change of employment - possibly I was wrong (as always).

Yours sincerely,
Dr. Watson

Alex,

I like your sense of humour. Good to see such on the NG. We approached the query differently and its always good to get various perspectives. Enjoy your weekend and have a pint on me oh my able sidekick

Vinodh,

It would appear from the information you have provided that the HO applied discretion in giving you a 2nd WP for whatever reason that may have been. It would seem that you would qualify for ILR after 4 years on WP and that this would be a straightforward application. However a lawyer would be able to review all your details comprehensively and put forward representations where any doubts exist. Ultimatley The choice of whether to get an immigration consultant or a lawyer is in your hands. Note that anyone providing immigration advice in the UK must be registered with the Office of the Immigration Service Commissioner (OISC) unless exempted.
http://www.oisc.org.uk/home.stm

Lawyers are exempted by virtue that they are regulated by their own professional body.

Our hosts www.workpermits.com may be of assistance in your case (note I am not soliciting for or advocating their services)

Good Luck

P/S I know a thing or 2 about immigration laws but no clue how to get the 'bold type quotation' from a previous post as In Alex's reponse to my Tier 2 application process - can I get some tips .
