I on student visa, however I am working full time in UK and have earned over 27K in last calendar month by doing two jobs at a time. Despite the fact, I am on student visa: Is there any chance that HomeOffice would consider my earnings for the past 1 year in Uk?????

My second question is: I have done 2 years BSc from subcontinent, I am also MCSE , have done a business course (4 months) and lately I have done MS from British University. My question is : How many points do I qualify for in education?

My understanding is that a student visa does not allow full time employment. Therefore I don't think the Home Office would look favorably on this income; they may even take action against you because you are violating the terms of your student visa. Also, are you paying UK taxes and NI on this income? Any income that qualifies for points has to be taxed. Finally, what types of jobs pay £27K a month? I would be interested!

On your other question, if you received the MS degree from the British University, you would get 25 points.

I think he means he has earned 27K uptill last calender month (in one year).

Casper is in big trouble if Immig dept knows about him.

Is 27K a year in the UK enough to apply for HSMP? I believe they require something around 40K?

Correction to original posting: 27K earned in last one year from 01/2003 to 01/2004.

Joseph01, thanks a lot for your reply and also thanks to every else for chipping in with their suggestions :-) Yes, I am a tax payer. I have paid around 5000 pounds in terms of tax and NI on this earned income viz slightly over 27K.

I know loads of students just like me, who are on student visas and working full time here, they are paying tax and NI contributions but still they get their visas extended each year by home office. My question is: If working full time is a violation (on student visa) then why home office grant us extension each year without even asking a single question???????? This is the only point, where I feel that probably the earnings I show over past 1 year are taken into account!

Unfortunately, my employer is not willing to apply wp for me that’s is why I got attracted by this HSMP option. But, after having suggestions from you guys, I am at a point where it seems, HSMP is also not feasible way out for me

Lough out loud, chess I wish but I aint a part time soccer star………. However, I work full time as a night auditor (hotel) and part time (in local council).

HSMP could still be feasible - you should be able to claim points for Academic/Professional Qualifications and experience.....

....however, you could say that you took a 'year out'...therefore earned some money

The big qusetion is - so you qualify without including income (as its less than 40K)

I assume you are under 28, and that's why you are asking about £27K, which is the minimum threshold for people under 28.

The question in your case is what is written in your passport stamp. If it says "no work" or "employment prohibited" or "holder does not engage in any business or profession" then you are not allowed to work, except possibly as a summer intern before graduation. That doesn't appear to be your case, is it?

If your student visa prohibits employment, the fact that they renewed your student visa doesn't mean anything because they probably assumed that you were only a student and not working. There is no way they would know you are working unless you or somebody else tell them. If you tell HSMP about your work in your application, they will know and see that your visa didn't allow that employment. So the first question is what your visa specifically says about employment.

ppl here on the forum have given u the right advices. I would also suggest u not disclose ur identity and personal details openly when discussing these sort of things in web.

I would say that u are lucky that u are making reasonably good money in current uk economy. So stick to ur job as long as u can and consider other options like marriage.
