New employer says that we don`t need to apply for a new Work Permit but notify HO about the change of employer in writing. I am not sure cause have heard thet I need to apply for a new WP? Could you clarify please. Are there any cases when person does not need to apply for new WP while changing employment within the same industry? |

Kayalami Member Member # 5984 | Posted March 07, 2004 12:09 PM Dip is correct - your new employer must get you a new WP from Work Permits UK. You do not detail your job so that we can ascertain if its a Tier 1 or Tier 2 job as per WP applications. Tier 1 applications do not need evidence of a resident labour recruitment search i.e. advertising. This include board level jobs, intra company transfers and shortage occupations e.g. nurses. Tier 2 applications need evidence of a resident labour recruitment search. Resident Labour pool is classed as any EEA national and those with settled status in the UK. Irrespetive of the Tier your current job is a move to a 'same/ similar job' is considered as a Tier 1 application which are typically processed within 1 day. In this instance the key fact is substantiating the similarity between the current and new job..that they are in the same industry is irrelevant..after all I could be in IT hardware or IT software in which case a job switch is same industry but not same/similar job. Of course if the new job is a Tier 1 job then its less of an issue. Note that you cannot start the new job until you have the new WP. -------------------- ---audi alteram partem--- |
