Greetings,

My name is Iliya, I am a Bulgarian citizen, and I am currently visiting a friend in Belgium. As far as I am aware, citizens of non-EU countries are allowed to stay as tourists in the EU for up to three months, but are not allowed to return to the EU immediately after they have left.

My question is: what is the required length of stay out of EU, once a non-EU person has stayed in EU for 3 months (and before they can return)?

And also: if I stay only for two months, will I be allowed to return (once I have left) after a shorter period of time?

I was wondering about similar question because of american friend i have that now try to go to Germany and stay indefinitely on tourist visa. I thought rule was that you can only be in EU for 3 month per year. I think you must stay out for a year now. I am not expert though. I may be wrong.

HI Ilya

I believe it is three months on a tourist visa out of the year, depending on your country of citizenship and residence. You may wish to check with the Consulate of the country you will be visiting for more information.

Hi Ilya,

I myself have visited and got tourist visa of Netherlands twice in one yr. The rule is that u can stay a maximum of 3 months once u have entered the Schengen states on a tourist visa. However if a stay of more than 3 months is needed, then at times the particular country can extend the visa. however thats only if u get lucky. The total length of stay ie stamped visa + extension granted cannot be more than 180 days overall.

Now coming to ur question. Once u have left the country on a visit visa (no matter it was of 1 day or max of 3 months), once ur visa is expired, u have to return to ur country and apply again which cannot be less than 3 months time.
Ie if u visited Belgium suppose on 1st January 2002 and ur visa was for 3 months then u will have to leave Belgium after 90 days in April. However once u r back, u can only apply after 90 days. This way, practically u can visit Schengen countries for a total of 180 days and remaining out of it for another 180 days
