Hello Marcis,

I got my GC in November 2000 as a E-Business Manager for a large German IT company.

In June 2001 I moved to the UK to open their UK subsidiary and came here with a SOle Representative Visa.

Now if I want to go back and apply for Permanent Residence (company is ready to pay EUR 80,00 per annum), do I have any chance or will they say that since I have not been in the country for 1 1/2 yrs (have been coming into the country every 4-5 months for 3-4 days stay) I should not even have the Green Card!?!

Hi Jackal,

Unfortunately, as you have been out of the country for one and a half year, your German Green Card would have become invalid during that time, and these years will not count towards permanent residence.

However, if you can wait until 1 January 2003, you might be able to apply for permanent residency under the "highly skilled employee" category then, as the new German immigration act will come into force.
