Hi There,

I'm looking for some advice for my husbands ILR application. I am british and he is Australian. We've hit a bit of a wall as we left it over 180 days between clearance & first entry to the UK. We are then a few months short of the 5 years needed to be spent in the UK. Will we have to apply to Leave to Remain again? Or is there a way around it?
11.08.14 - Visa Granted
12.02.15 - Arrival in UK
05.05.17 - Renewed LTR
28.10.19 - Second Visa Expires

All help in advance appreciated.

Is it a spouse settlement visa??

Presumably it is and his residence clock for ilr starts from the date he entered the UK. He will need to apply for another 2.5 year extension, current visa fee is £1033 plus IHS of £1000 and meet all the same requirements again to cover the shortfall.

There is no way around on this, unfortunately.
