Hello Everyone,
Please link me to the post if this has been discussed in in past
I am on ILR and my wife is on Tier 2 PBS dependent visa.
Her current visa expires 01-10-2019
Entry to UK 07-03-2015, she is due for ILR March 2020
All I need a 6 months visa or a 1-year Visa so that she can finish her 5 years on a PBS route and I then apply her ILR
I have started to fill the application as a Tier 2 dependent and I only have 2 options less than 3 year or more than 3 year. If I select less than 3 year then of course the application fee and additional IHS fee for 3 years which his £1200 and the visa will only be used for 6 months or less. This sounds too expensive to me and also why should I pay when I don’t need a 3 years visa. Please can someone share their experience or let me know what is the best way to extend the visa for 6 months or 1 year under PBS route without breaking the continuity she has from March 2015
Also, if her visa is going to expire on 01-10-19. Can someone answer below
1. Would it be okay If I submit her online application on 30-09-2019 ?
2. Also do we have to visit application centre to submit finger prints/photo before the visa expire or only the online application needs to be submitted online before the visa expiry date ?
As per the maintenance. I need to show a shaving of £630 for my dependant. In the past when I apply her EC visa my employer gave me the letter to support her maintenance (no bank statement was submitted). When I extended her last visa I used the same letter and no bank statement was submitted.
I am now on ILR, can I still submit a letter from employer that maintenance will be provided if needed or I do need to show a saving of £630 for 3 months.

What was the start date of her initial dependent visa?? ILR qualifying period starts from visa issue date and not date of entry to the UK.
Your employer cannot certify her maintenance as you now hold ILR. You will need 90 days bank statements with a minimum of £630 held for the full 90 days.
The Immigration Rules state that when the main PBS migrant has ILR or British citizenship, the PBS Dependent extension will be for 3 years. You cannot choose a lesser period of validity.

She can apply for ILR no sooner than within 28 days before 21st January 2020.

I now have filled the application form for my wife using Tier 2 dependent route up to 3 years. I finished the form and then the application routed me to IHS website directly
As you are aware that my wife is only 3 months short to apply ILR but the only option is to apply her extension upto 3 years. I filled all the relevant information on the IHS website. it did ask to enter the expiry date of BRP to whom you are dependent. My ILR expire on 31-12-2024 which I did enter and it has calculated to pay £2200 IHS.
Now as you have declared that this information is correct I cannot change any details on IHS form and also the application is locked as well until you don't pay IHS
can anyone help me what I need to do now. I am sure i don't have to pay £2200 IHS fees calculated on ILR expiry date which is for 5.5 years
if we cant reset. should I create a new account and fill the form again
what would I enter when I get to the same point. what expiry date I need to mention on IHS form or should I just enter a random 1 year date ?
as application is blocked does that mean it is submitted. I have not paid IHS and also have not paid any application fees

Enter your ilr expiry date for 3 years from now to get the correct IHS, ie X September 2022.

Each time I log in now it ask me to pay IHS and when i click on website it only says to pay £2200 because I have filled the details and application is blocked already. I cannot change details
Does that mean that I now have to create a new account and start a new application
I think this is the best way and will not be an issue as i dont consider application to be submitted because have not paid IHS and application fee

No!!! As has already bee advised, she gets a 3 year extension as stated in the immigration rules. You cannot choose a lesser time that suits you. If you don't pay the IHS for 3 years you risk a refusal or delay as ho will write to you to pay the balance.

so if my wife visa is expiring on 01-10-2019 and I apply online on 29-09-19
once application is submit .you have 60 days to book/submit your biometrics. Would it be an issue if I submit between 55-60 days. I have asked this that if they are unable to give decision until 24th Dec. She will be eligible for ILR
Would it be a chance that I can vary my application on priority and apply her ILR. this way i would be able to get refund for my IHS fee ?

If you do not enroll biometrics within the 45 days, the application will be rejected as invalid.

okay thanks for the information
so if I do enrol biometrics in 30 working days and if UKVI cannot give decision end of December
can I request to vary the application by 24/12 so that IHS can be refunded ?
is this possible ?

Yes you can vary if a decision has not been made. You will need to apply online and pay the ILR fee and I believe there is an option to say you have a pending application with HO.
Possible to get IHS refund.

on the application form, one of the document requirement is
Document showing you and your partner are living together (for example, a utility bill, council tax bill or bank statement)
what is the period of this document (like from last 6 months or 1 year or 2 years)
I have moved house in September and I have mentioned on the application form that we moved in Sep 2019. the application didn't ask any further address or any such question to provide any old address
for the new house in which we have moved I do have council tax letter, joint bank stamen, British gas bill showing both name which will demonstrate that we both live in the same house.
Would this be any good as that will only show September, will not provide where i was living in the last couple of month or years
Do you suggest that I should write a cover letter and explain that we recently moved so here is the proof and then also mention the old address and add couple of proofs from the last 1 year that we both live together

It is asking for evidence of cohabitation and living in a subsisting relationship for at least the 2 years preceding the date of application.
The form only asks for current address. Your evidence cannot only be for one month.

No issue. It simply needs to be addressed to both of you at the same address. HO don't care how many times you move.

3 to 6 different sources, spread evenly for every 3 to 4 months.

Date of application is the date you submit and pay online and NOT the date of appointment. Your supporting documents must be dated ON or BEFORE the date of application.

finally I have submitted the extension application yesterday 29/09/19
i was advised that we have 45 days to provide biometrics but after submitting I am able to see as below
Attend an appointment to provide your documents and biometrics by 29 November 2019 …
does that mean I have 60 days to give biometrics or does that have to be within 45 days

Date of UKCVAS appointment is irrelevant. The key date is the date of application, which is the date you submit and pay online.
