PBS dependant spouse Visa with main applicant having ILR now.

Post by pooja13 » Mon Feb 10, 2020 12:14 am

Hello all,

I have few urgent queries regarding my PBS dependant Visa application.
Some backgrounds before asking question:
I arrived in the UK in Jan 2016 on PBS dependant Tier 2 visa. My current Tier 2 PBS dependant Visa expires in May 2020. My husband has recently got his ILR in August 2019 and on his BRP card his expiry date is in 2024.
As I am falling short of 8 months to qualify as PBS depedant to apply for ILR, I will have to apply for another Visa extension in May 202 to take me to Jan 2021.

My questions/ queries?
1. I guess I will have to go for 3 year PBS dependant route ?

2. Will the expiry date in my New BRP card take me to January 2021 so that I can apply for ILR or I will get full 3 years of Visa ?

3. The IHS fees is a big issue, as when we put main applicants expiry date (which is my husbands ILR date and its in 2024) which brings the cost to £2000 (400x5 years). What is the way it can be kept at 1 year fees or maybe 3 years for my new Tier 2 PBS dependant extension Visa? what are the ways it can be changed when selecting options in IHS website?

4. Also for maintenance funds (£630) for 3 months - can we show ISA saving account ?
In my previous Visa extension in 2017, we were never asked to show any maintenance funds as we were extending Visa in same category. Not sure why they are asking it this time ?

Any form of help and guidance will be very much appreciated . Thank You

Correct
2. Will the expiry date in my New BRP card take me to January 2021 so that I can apply for ILR or I will get full 3 years of Visa ?
Extension will be issued for three years (max length) as your husband has ILR. Also your ILR eligibility has nothing to do with the expiry date of the visa, it is based on the very first visa issue date. Count 5 years minus 28 days and that is the day you are eligible to apply for ILR
The online form has some technical issues and this is one of them. As the extension is granted for three years, the trick is to put an expiry date that makes you pay the correct IHS fees for 3 years so you don't end up overpaying a large sum. So instead of a date in 2024, enter an earlier expiry date that gets you to £1200. This has no effect on your visa application.
4. Also for maintenance funds (£630) for 3 months - can we show ISA saving account ?
In my previous Visa extension in 2017, we were never asked to show any maintenance funds as we were extending Visa in same category. Not sure why they are asking it this time ?
PBS dependants applications have always had the maintenance requirement for 90 days

Thank you for such a smart idea, will try and do it.

Thanks for the info. Also from your experience, can you confirm if we can use ISA account statement of 90 days for maintenance of funds ?
