PBS Dependent to Family visa (ILR) eligibility

Hi,

I m currently an ILR holder based on Tier-2 (General) skilled worker.

Timeline : May, 2013 - May 2018.

I got married in UK and my wife switched from Tier-4 to PBS Dependent in October, 2016.

We both extended Tier-2 (General) in Jan 2018 which was granted till May 22, 2019.

I applied for ILR in May, 2018 and got it successfully.

However my wife still lives with me in UK with her current PBS Dependent expiring in May 22, 2019. If she applies for extending her stay again now for 2.5 years as partner of settled person (Family visa),

1. Will she eligible for ILR in October 2021?
2. Is her 5 year probationary clock reset again from now?
3. Is she eligible for ILR already?

Any advice will be useful.

She needs 5 years under PBS dependant route for ILR. So she should stay under PBS dependant until eligible for ILR in 2021. Switching to FLR(M) will reset her ILR clock.

We are on the right track now however a slight hiccup. My wife doesn't have the minimum funds in UK bank accounts alone.

However she has 4 bank accounts:

1. UK joint savings account (myself and my wife's)
2. UK personal account (my wife's)
3. Indian overseas joint bank account (my wife's and her uncle)
4. Two Indian overseas personal bank account NRO & NRE (my wife's)

Combined balances of all the above accounts doesn't fall below £630 in the 90 days period.

Would this be acceptable from the Home office perspective?

Hi,

Can someone help me with this query below please?

" have indefinite leave to remain Visa (from Tier-2 (General) five years rule). My wife's PBS Dependent Visa is expiring in 2 weeks but needs to extend from within UK.

In order to extend, my wife doesn't have the minimum funds in one UK bank account alone.

However she has 4 bank accounts:

1. UK joint savings account (myself and my wife's)
2. UK personal account (my wife's)
3. Indian overseas joint bank account (my wife's and her uncle)
4. Two Indian overseas personal bank account NRO & NRE (my wife's)

Combined balances of all the above accounts doesn't fall below £630 in the 90 days period.

Would this be acceptable from the Home office perspective? "

You can only use an account in either YOUR name or HER name or in your JOINT names. You cannot use the account she holds with her uncle.

Hi,

Can I submit my bank statement (on my my name only) even though I have Indefinite leave as I saw a rule in the guidance which states I cannot sponsor my wife's maintenance if the main applicant has moved to ILR?

Where exactly does it say you cannot use your bank for your spouse maintenance???

You are probably confusing the fact that your tier 2 SPONSOR cannot certify maintenance funds for dependents if the main PBS migrants holds ILR.

Yes I think we got confused with certifying the maintenance for the spouse.

Now we have the following bank statements to show evidence of funds:

- My name and my wife's Joint bank account (UK)
- My wife's personal bank account (UK)
- My personal bank account (UK)
- My wife's overseas NRO SAVINGS Account - Electronic Bank Statement sealed and signed in original received by post (Recognized bank from Home office on the list of accepted financial institutions from India in the online application)
- My wife's overseas NRE SAVINGS Account - Electronic Bank Statement sealed and signed in original received by post (Recognized bank from Home office on the list of accepted financial institutions from India in the online application)

The combined balances of all the above accounts does not fall below £630 minimum for the continuous period of 90 days. We are short of only one day (80th day in the 90 day period - for which we need all these 5 accounts together to cross £630). We are also planning to add the OANDA conversion for the date of application submission.

Finally, both the overseas accounts (as per point 104.(iv) on the PBS dependent guidance) are only Electronic bank statements sealed and signed and not a letter from the overseas bank because both these accounts have less than the £630 but help to add up the shortage on that one day between all 3 of our UK accounts.

Am I finally on the right track? Will the bank statements from overseas suffice instead of the letter?
