Dependent Visa Extension - ILR clock reset

Post by SharvWani » Sun Jul 09, 2023 9:02 am

Hi, I am currently on a PBS Dependent Visa and have been in the UK for 3.5 years. I have applied for a Visa Extension through the 'Family Route' option on the basis of my wife's recent ILR. I also provided my wife's previous tier 2 general visa references within the application.

I have my visa appointment next Wednesday (12th) and was told by a friend that ILR clock might reset (back to 5 years) given I have applied on the basis of my wife's ILR and not her tier 2 general visa. Can someone help me understand if my ILR clock would reset/ what's the best way forward?

Yes the clock will reset to zero and a new 5 year route to ilr.

You should extend as a PBS dependent to keep yourself on the current path to ilr.

If your wife got ILR based on a 5 year Skilled Worker woute, you would be better advised to remain on the PBS Dependent route till your own ILR.

If your wife got ILR based on Long Residence, you may be required to switch over to the Family Dependent of a settled person route. And yes, that would reset your clock to zero.

So the crucial question is, under what route did your wife get her ILR?

Not anymore, the rules have changed and PBS dependents can continue and apply for ILR based on PBS dependent 5 year route.

Whence the "may be" in my post :)

I remember coming across that in a discussion (between @vinny and @zimba I think), but I wasn't absolutely certain.

I tend to be conservative (with a lower-case "c") and go by the most restrictive interpretation of the situation.

PBS Dependent Visa Extension - Partner's UAN

Post by SharvWani » Thu Jul 13, 2023 11:14 pm

Hi, I am currently on PBS Dependent Visa (due to expire) which I got on the basis of my partner's Tier 2 General (Skilled worker visa). My partner recently got her ILR.
Now I am trying to extend my visa and the visa application requires me to provide my partner's UAN.

In this case, should I be providing the UAN from her Tier-2 general visa application or the UAN from her ILR application to ensure that my ILR clock does not reset to 0. I am pressed for time so any help on this is much appreciated.

Preferably use the most recent one and this will be used to access information that HO have on file for her.

ILR clock has nothing to do with the UAN. :? As long as you extend under Skilled worker route, you are good to go
