Pbs dependent when main applicant is ilr

Post by somu1281 » Sat Feb 04, 2023 7:21 pm

Hi,
I have recently got ILR Set O in Jan 2023.
Health and care visa 5 year route.
My wife and child will not qualify to apply for ILR until next year.
Their current pbs dependent visa expires in Jan 2024.
My question are:
1. Do I need to apply for their ILR dependant visa despite their current valid dependant visa.
2. I couldn’t find any link to apply for ILR dependent. Do I apply again as a health and care dependent visa.
3. I could find any link to visa fee for ILR dependent.
Can you please help?
Regards
S

They do not have to apply for another visa. They have a current visa and can remain in the uk on their visas.

Thanks
But my wife won’t be eligible for ilr until Oct 2024 and her current visa expires in Jan 2024 so she will need dependent visa extension.
My question still remains:
1. What category of dependant visa will I need to apply for her.
3. What’s the visa fee.

She applies for a skilled worker dependent visa. It is a 3 year extension

Thanks
My ILR BRP expires on 31st December 2024.
Will they still need a 3 year extension. If that's the case then shouldn't I apply now as I will end up paying the same fee even if I apply in Jan 2024.

It is the card they expires, not your ILR. Brp cards are being phased out. All the details are on ukvi's website if you search for "brp errors". This has been answered multiple times on the forum recently

The immigration rules state depednets will get a 4 year extension when the main visa holder has ILR. There is no discretion and you cannot choose a lesser time for the visa extension.

Your choice.

Hi, Is it a 4 year extension by default for dependents when main visa holder has ILR, or a 3 year extension?
I was filing the application for wife's extension (I got ILR last October), who completes 5 years in Dec 2024. I paid 2 years IHS (£1248), but when I proceed to pay the visa fees, it is showing £1423 by default. This means that it is for 3+ years. There is no option to specify the duration.

1. You should start your own topic if you have questions. It is considered rude to tag onto and hijack another members thread with your own questions.

2. It is a 3 year extension as stated in the immigration rules. IHS end date needs to be 3 years in the future, regardless of the ILR BRP expiry date. If you have not paid the correct IHS, it will delay the application and UKVI might write to you to pay the difference.
