Crime record & immigration

Post by karma » Tue Sep 11, 2007 5:20 am

I was charged for a stalking crime. I was sentenced 12 months probation 7 years back. How does this affect my application for skilled migration to Australia?

.

What country were you charged in?

What date did your probation end?

Were you ever fined or ever jailed?

What country are you a citizen of, and which country are you coming from?

I'd have to look up Australia law, but other countries usually ask for full police record for all places lived for the past five years. Sometimes it is ten.

Canada, for example, makes its decisions based upon what you would have been charged with and what your potential sentence could have been if you had committed the crime in Canada.

The amount of time since the penalty/sentence is completed is more important than the date of conviction. Also, there are varying definitions of 'rehabilitation' to prove you are not a danger to society. Some are time dependent, some are dependent on completing rehab programs. Details vary depending on the severity of the crime.

I suspect that Australia uses a similar model, although details will vary.

Im asking the same question as im about to travel Australia
I have a minor UK conviction from 1994, i had a fine, no prison sentence

As far as ive found out its not a problem. Its an minor offence, an old conviction and i didnt go to prison

Ive just visited Canada for the first time, when I phoned the Canadian embassy before i left i was told it would be absolutely fine, and I think the immigration laws will be the same for both countries

Its the USA I need a visa for, as they are paranoid of everyone

Id phone the embassy in London, theyll give you the answer you need-
Australia Embassy

Best of luck

Sorry for delay in reply.

I was charged in the USA.

My probation was ended on Dec. 2001.

I was fined USD 500, no jail sentence.

I am a citizen of India and I am applying from India or Oman.
