Please help which visa

Post by Joysinthu » Wed Jun 28, 2017 6:09 pm

Hi
I have been on ILR since 2014 and my husband is currently on the PBS dependent.
Initially he was given 2 years PBS dependent from 2012 and got another 3 years extension from 2014.he is due for his visa renewal.
My questions are
1.can he apply for ILR as he has been my dependent for 5 years
2.if not which visa pathway does he go for
3.which application form does he use

More than happy to take any advice on the above matter as am really confused.
Please help urgently.

Many thanks
Flo

What date exactly did he APPLY for his first dependent visa in 2012??

On what basis did you get ILR, 5 years Tier 1 General or 10 years long residence??

If your dates are correct, then he is under the old rules and only requires 2 years residence. Are you sure about when he entered the UK (2011)??? What visa was he on??

Did he apply for Tier 1 Dependent on 30/4/2012?? Where did he apply, abroad or in the UK?

I am looking at his passport while I type this message.he was first granted tier 1 general partner visa on 09/11/2011 and entered un subsequently on the 07/12/2011.
His visa expired on the 04/05/2012 so we applied together for the tier 1 general points based system on 30/04/2012 and the visa issued on the 04/09/2012.

Such a pity you didn't post sooner.

He could have applied for ILR at the same time as you in 2014 as he only required 2 years residence.

He did apply for ILR in 2014 but got refused as ielts results expired.was advised by the immigration officer to re apply under PBS and that's when he got the 3 years expiring in 23/08/2017...
So what do we do now
