maintainance funds

i was due for indefinite leave o remain under old rules in may 2008,(completion of four years)
Now will I have to shift tier 1to take an extension?
Also for funds can I show joint account with my dad in india for self,wife and two dependants.

Please refer to the rules which clearly says that
for dependent visa u should show funds which has not been shown for the main applicant
