Effect On Tier 1 gen Dependent Visa

Post by yusafg » Tue Feb 13, 2018 11:23 am

I am British (I got this status via tier 1 Gen, 5 years’ route) and I have one daughter (British, 2 years old). I have question regarding effect on my wife visa (Teir 1 Gen, Dependent visa, 5 years route) if I take benefit.
I have been redundant last year and I found job after 2 months and I have to spend £3500 to meet my expenses.
I did not get any help due to fear that it could effect on my wife visa extension time.
I got temporary job and this is not permanent and It will finish around April 2018.
My question is that If in case I lose my job. Can I take benefit from government on my and daughter basis?

Note: My wife still on dependent visa (ILR Due on 2020).

Please Advise.
Regards

Yusaf

You are entitled to claim as you are British. Child benefit in YOUR name only. Tax Credits MUST be claimed in JOINT names with your spouse. Housing Benefit will be single plus child rate and ALL household income will be used to work out your entitlement.

When does your wife qualify for ILR? When did she enter the UK as Tier 1 Dependent if that is the current visa she holds?

Hi,

Thanks for your reply.

Wife Current Status: Tier 1 General Dependent Visa
Visa Issued: 22/10/2014
Arived In UK: 26/11/2014
Visa Issued : 21/10/2014 to 22/04/2015
Extension: 23/04/2015 to 22/04/2018
Applyinf for extension: Afer 25th Mar 2018.
ILR Due: Dec 2019

She is not my spouse but she is my dependent. I think spoue visa is different than dependent visa.

It's mean that I am secure to take benfit if I need it.

Question: I was reading form (tier 1 general dependent visa) for my extension which will be due next month.
There are lot question regarding taking benefits. I put answer "No" to all answer regarding the benefit because I am not taking any benefit apart from child benefit. Did I done correct? Please advise.

Regards

If you are married then she is your spouse, i.e. wife!! A spouse can hold different types of visas.

Tier 1 Gen Dependant Visa Query

Post by yusafg » Sun Feb 25, 2018 11:17 am

Hi All,
Hope you are fine.
I am in process of filling my wife extension (2 years) form (Tier 1 General Dependent Visa).
I have following questions please.
Section L: Public Funds
L1: Have you ever claimed any public funds.
Option: Yes and No
Answer: No
Then there is series of questions From L1 to L21.
L4: Have you claimed child Benefit
Option: Yes and No
Answer: No (Is it right answer)
L5: Have you claimed Tax credit
Option: Yes And No
Answer: Yes (Is it right answer)
So, Do I have to tick Yes on L5? (As you know tax credit under husband and wife name).
But, I received tax credit for three months on last year.
If I Put “No” then it takes me on section M.
Do I have tick any answer under L2 to L21?
Please advise.

Note: My status is now British (Route: Tier 1 General ,5 years).
Regards,

Yusaf

Yes, for the last 2 years.
1-Tier 1 General Extension Form (3 years already Completed, 2 years extension remaining)
It is a 3 year extension she is applying for, not a 2 year extension.

The immigration rules state that a PBS Dependent will get a 3 year extension. You cannot choose a visa for less time.

Hi All,

I have one more question regarding "M10A: Is the main applicant's sponsor certifying your maintenance?"

I have bank statement which is showing 90 days for maintenance of funds. Do I have to provide only statement with Tier 1 General Dependent visa or I have to provide any thing addition to bank statement?

Regards,

YG

Only bank statement.

You are no longer sponsored so your 'sponsor' cannot certify maintenance.

Hi All,

I booked appointment on 29th Mar 2018 in Croydon for my wife for Tier 1 General Extension.
I filled the form and get ready others documents. I have confusion regarding following questions.
Please advise.

I am British now(Via Tier 1 General route).
There are questions under Section "M" where I need your advise please.

M1; Are you applying for leave at the same time as the PBS main applicant that you are
dependant upon? Go To M4

Answer: No

M4; Has the PBS main applicant received notification that their application has been
successful? (ht)

There is two option "Yes" and "No".

I am British and I did not select any option. Is this right?

M7; How long has the PBS main applicant been in the UK for?
Less than 12 months - go to M8
More than 12 months - go to M9

I selected "more than 12 months" then I proceed to M9.

M9; Please tick the box below:
I can confirm that I am providing evidence of having £630 in available funds.
go to M12

I am providing my bank statement. Do I need to supply letter as well?

M12; You must provide evidence that you have access to available funds in order to support
yourself. Please tick the relevant box to confirm what evidence you are supplying:

Answer: I am getting confirmation letter from my bank regarding 90 days balance.

I look forward to hear from you.

regards
YG
