hello respected members

I was on a tier 1 visa and finally got my British passport.
My wife who came in 2010 as a tier dependent is still on dependent visa which runs out in june 2018
she hasn't passed her required tests as yet and i was wondering that if i have to extend her visa again what forms is to be used and what are the maintenance requirements.

Me and my both children have got British passports but my wife is still on dependent visa which i extended 2.5 years ago

please guide

Tier 1 dependent form.

£630 maintenance funds for 90 days.

It will be a 3 year extension and she must pay the visa fee (goes up in April) and the IHS of £600.

thankx for the prompt reply

so despite me being a British citizen she still has to apply as a dependent of a tier 1 visa holder and not British citizen dependent.

maintenance funds requirement is 630 thanks but which form to use and what fees am i looking at also do i have to fulfill any earning criterion or being economic active is good enough

If she applies for ILR dependent visa, her clock for ILR will be reset to zero and a NEW 5 year residence period (2 x 2.5 year visas).

Tier 1 General Dependent form as I have already stated. No earnings requirement. Fees are £1806 postal plus she has to pay £600 Immigration Health Surcharge. Fees go up in April.

SO the best possible remedy to this situation is to apply for a second extension as a tier 1 dependant as she hsant passed LIFE IN UK n B1
what if she passes those tests can she apply for ILR or still apply for extension so as not to reset the clock
sorry for asking the same question again in a different way but just trying to make sure that i am well understood

If she passes the tests BEFORE her current visa expires, then yes she can apply for ILR.

If she does not pass the tests, then she will have to apply for a 3 year Tier 1 Dependent extension. At any time AFTER she gets an extension, she can apply for ILR once she passes the tests.

Applying for a Tier 1 Dependent extension DOES NOT reset her clock. It is only reset IF she applies for ILR dependent on form FLR(M).

also me being a British citizen how will i tackle the IHS charge issue i mean what dates shall i put for her IHS charges
shall i just put a date 3 year from now or what else can i put
also double checking about the earning requirement hope that not relevant in the re extension case

Yes, 3 years forward.

Note that she applies alone.

No financial aspect for PBS Dependent extension. Only the maintenance fund requirement.

thankx again thats really fast reply

also can she use my old brp in the application coz thats the only reasonable option to fill in and does she have to state that i am a British citizen or use my old nationality in the application
her visa expires on the 2nd July so once i apply online by 30th (thats when the 90 day funds requirement fulfills) print off the form and send the printed form and supporting docs via post

She must be honest. You are no longer a visa holder so your BRP is no longer relevant.

If you are only British, that is what she must state.

thats a bit confusing as if i am British and if she cant use my old brp details how would they extend her visa based on my new status wouldn't they redirect her to apply in any other category

when paying IHS charges the dates she would be putting post 3 years is her dates isnt it

No, the rules allow her to extend if you got ILR via the Tier 1 General route, link to rules below.

You need to go through the online form and answer the questions truthfully.

Hi again
i am trying to pay IHS surcharge which on the intro page says 200 per year so based on that i put the visa expiration date post 3 years for me but it calculates as 700 not 600 am i missing anything again
