UK spouse visa renewal - change of circumstances

Post by lala44 » Tue Feb 13, 2018 11:50 am

I was originally on Tier 1-General, then ILR, and I have now become a British citizen.

My wife's dependant visa was based on my Tier-1 visa but now that I have become British, do we renew it as Tier-1 spouse visa or spouse visa for a British citizen?

I will be very grateful for your advice.

Tier 1 dependent extension.

Spouse visa (of BC or settled person) on FLR(M) will reset the clock to zero and a new 5 year residence period (2 x 2.5 year visas).

Dear CR001,

Thank you very much for your reply, much helpful.

Another question which I will be very grateful for your advice -
My will be eligible for PR based on 10 years continuous stay in September 2018 (she originally came in 2008 on a student visa, then PSW, then Spouse visa).
Her current Tier 1 dependent visa is due to expire in July, about one and half month short of when she can apply for her PR.

Is there any way the home office may show discretion and grant her PR in July if we apply, or is it best to extend Tier 1 dependent visa first and then apply for PR once fully eligible?

Many thanks.

The good news maybe for you is that she can be eligible for ILR based on long residence 28 days before of her visa expiry which means out of 1.5 months gap only 17-18 days gap left. For this purpose she has to apply for extension then once she hit the required time for long residence can vary the application into long residence.

For Long residence, it’s 28 days prior to the completion of her 10th anniversary of her initial entry, not 28 days before her visa expiry.

I was trying to amend it in my post but I couldn't be able to edit my typing error. yes you are right its 28 days prior to completing 10th year.

Many thanks for your replies, much appreciated.

I guess we will have to extend wife’s Tier 1 Spouse visa first and then apply for ILR afterwards. This is because –
a.Her current Tier 1 Spouse Visa expiry is 10/07/2018
b.10 year stay period will be achieved on 28/09/2018
c.Her date of first arrival in the UK 28/09/2008

Number of days gap between A and B is 80 days (more than what I had originally thought)

Funds for renewal of Spouse visa - Tier 1 (General)

Post by lala44 » Fri Mar 09, 2018 10:23 am

I was on Tier 1 (General) but have now got my ILR.
Nonetheless we still have to renew my wife's spouse visa as Tier 1 dependant and this is due for renewal soon.
I wonder how much funds do we have to show?

Is it -
a. £630 in total, or
b. £945 + £630

Many thanks as always, CR001.

I will be BC effective this month, attended ceremony and awaiting my passport.
Wife has been on Tier 1 Dependant since October 2013.

Still just the £630 of funds needed to show?

We are doing a same day service and have made payments online.
However on the application form there is a payment section.
Can we just leave this section blank as we have already made our payments?

Leave blank. The payment page is relevant if applying by post.

Tier 1 Dependant visa successfully renewed. Many thanks for the advice.

PS - We went to Cardiff for a same day appointment and had a very pleasant experience. Staff were friendly and helpful and the wait wasn't long (around 2.5 hours spent in total from arrival in office to departure from office). We would recommend going to Cardiff to anyone doing a same day appointment. We stayed in a hostel called Nomad - Cardiff which is about two minutes away from UKBA office and is very cheap.
