Guys

I have been just approved with 50 points.my solicitor has just forwarded an email that home embassy sent and it says the same which amona has mentioned outside monthly allocation exceptionally granted.

This forum is really amazing,Thanks all
Can you also please check and share if your employer had sent a request to Home Office to consider your application outside of the monthly allocation process and if so, based on which grounds?

If there was no request, then my below assumption may be correct:
To accommodate 50 points band, 100 certificates have been borrowed from next month. But, there may be a few more applicants say 5-7 still left over, and it may be possible that HO would have granted CoS to such 5-7 applicants exceptionally to clear the 50 point band!

Here, 5-7 is just assumption which may be a little more.

Example:
Let's assume 300 certificates were still available after granting RCoS to all Shortage Occupation / PhD and anyone with 55 or more points.
Now, assume there are about 409 (+/-) applicants in the next band which is 50 points.
The remaining 300 certificates are not sufficient to accommodate all 409 applicants. So, 100 certificates have been borrowed from next month (as maximum 100 only can be borrowed). Still there are 9 (approx) applicants left over in 50 points band. If they don't consider these 9 applicants under exceptional case, then all the 409 applicants have to be refused.
Now, HO obviously can decide on their own terms to grant a few certificates exceptionally to clear the entire 50 points band, which makes sense.
I believe this is what has happened this month.

If so, we are expected to see the cut-off at 50 points with 100 certificates borrowed from next month.
Yeah, this in an interesting theory. I think they have done _something_ with the 50 points to bring it down to 46 - if only for optics.
It will be 50, not 46 in this case.
46 will be when all 50 point applicants are approved, but the remaining certificates are carried over to next month.
50 will be when all 50 point applicants are approved by borrowing upto 100 certificates from next month.
In both the cases, only applicants with 50 or more points only are approved and all the applicants with 45 points have been refused.

No special request from my solicitor, the decision to give it exceptionally is home office decision.

As the HO has reverse 1 3rd of the rcos goes to NHS and another portion goes to shortage occupation n we are left with half for which all of us are struggling.

This government very adamant, they are ready to comprise on their economy for votes.

it is such a sad state for people in the 40s - every month one starts with hope and then ends it in despair at the sheer hopelessness of the archaic system. When will the cut off score drop to 40 is the next battle here!! all the best for May - really feel like telling the high salary guys - leave one month for us! gutted and another 30 days of emptiness again

I don't think it's the high salary guys that are causing this. The NHS is hiring 5500 nurses from India and Philippines over next few months. As you guys already know,The nurses get an automatic 130 points owing to shortage occupation. The conservative immigration minister has specifically asked the 20800 COS available annually to cover the shortage occupation list as well.I am not that well informed Guys,I could be wrong here. Please feel free to correct me.Thanks

Yes you are right but this was at on news at November 2017 . We don't how much they recruited so far but all are just our assumption and finding ways to console ourselves for being defused by HO for the past 3 months

It might be worthwhile to reevaluate going to the UK for those of you that have a chance to achieve a better quality of life somewhere other than the UK. The Home Office appears to have little interest in solving the current crisis and the current UK government have repeatedly shown they do not care about the well-being of immigrants in the country let alone "potential" immigrants such as ourselves on this forum.

I myself have met some wonderful people and friends in the UK. However the country's hostile immigration policy has really left a sour taste, we pay application fees and charges that are far beyond many countries and yet are essentially second class citizens once you get there. Even if we all get a Tier 2 visa tomorrow the reality is we will probably face a bigger hurdle in a few years time when we want to apply for ILR.

I understand there is a process but it just seems so unreasonable that there are people who have been applying for almost 6 months and continue to be refused but then higher salaries are approved the first time around. Is it because they pay more taxes? This issue is also surely creating shortages in other industries?

In all honesty I’ve lived in the Australia, Singapore and the UK and of those 3 in my opinion the UK has the poorest standard of living/qualify of life by far, however having been there for the past 2 years I have a life there and people expecting me back that I didn’t even get to say goodbye to so I was really hoping to get back there. I have to say though that the longer this has gone on the less and less keen I am to go back. My employer wants to keep trying for as long as it takes but I really need to think it through because with my points it’s going to take ages and ages (if ever) and I need to think about whether going back there would actually be worth even more months of living in limbo (and at the moment wanting to stop living in limbo is far more appealing than the UK to me). It really comes down to everyone’s personal situations. I’m sure everyone is trying to live/work in the UK for different reasons.
