ILR through Tier1 entrepreneur or 10 years category

Hi everyone,

Please see below and answer the following if anyone knows the answer.

1) I got student Visa in February 2009 and came to UK on 14/02/2009 (Tier4 student route)

2) Completed my course in March 2011 and left to India on 31 March 2011 (Visa expired on 1st April 2011)

3) Applied for PSW visa from india in July 2011 and got PSW visa to UK from 1 August 2011 and back to UK on 10 August 2011.

4) PSW expired in August 2013 and applied for tier1 entrepreneur visa in August 2013 and got my visa in December 2013

5) Applied for tier1 entrepreneur extension in December 2016 and got my visa in February 2017

6) My current visa (tier1 entrepreneur extension) expires on 2 February 2019 and my 10 years will complete on 14 February 2019

My question- I'm eligible to apply for ILR through 10 years route ??? or only tier 1 entrepreneur 5 years route only??? or eligible for both???

I'm worried about the 12 days gap in between my first entry and current visa expires and also I left to India after my studies for few months (eligible for 10 years or not)

If anyone knows the genuine answers please share here.

Zimba or any of the senior members please help me.

Assuming you can meet all other conditions, on the basis of length of stay, you can apply for your T1E based ILR in Nov 2018 (28 days before the 5th anniversary of your visa grant date) and for ILR-LR after 17 Jan 2019.

You definitely need to apply for the T1E ILR before the visa expires on 2 Feb 19, so that means you can choose to do either.

Your absence is less than 180 days between student and PSW, so that alone will not disqualify your 10 year residence.

As you left with a valid visa and returned within 6 months, your can apply under 10 years route too. Remember that SET(LR) could have adverse effects on your dependents ILR if you have any
