Re Holidays Check

Post by cvs » Sat Aug 11, 2018 2:43 pm

Hi,
I'm on ILR visa currently and my wife on Tier 1 General Dependent Visa.

Tier 1 General Dependent Visa:
04-09-2014 Issued in abroad - 27-10-2014 (Entered UK) = 54 days out of UK
2015 = 34 days out of UK
2016 = 30 days out of UK
2017 = 41 days out of UK

I have 3 questions,

When she is eligible for ILR?
How many days she can go out of UK?
She done masters in abroad, is that sufficient for English requirement?

could some one please answer?

Thanks!

1. No sooner than within 28 days before 4th September 2019.

2. There is no absence limit for PBS dependent visa issued before 11 January 2018.

3. No it is not. She needs UK NARIC red route or English B1 test. Both cost the same, £150

Thanks a lot for quick reply CR001,

I have last few question, you mentioned as below
> There is no absence limit for PBS dependent visa issued before 11 January 2018.

She is going for Tier 1 general - dependent visa another extension in April/May 2019.
So till that date what ever holidays she takes, no limit on that. am i right ?

And she is eligible for ILR, 28 days before 4th September 2019.
In between that period there is limit for not exceeding 180 days. am i right ?

If yes for above, is that 180+ days considered as if one go take or even it counts as split (going out of UK)

Could you please clarify these final questions.

Thanks!

Correct to your two questions.

The absence is 180 days of absence in ANY 12 month rolling period.

If she wants to get ILR, suggest keep absences to a minimum, especially as HO can and do change rules fairly often.
