High Court Ruling - HSMP Extension

Post by rajivferroin » Wed May 14, 2008 12:41 pm

I have called Home office customer service to check about high court ruling impact on hsmp extension.

Initially they told me that i need to fill tier1 form, then i told them about High court ruling and home office letter to HSMPForum, then they said that today or early next week homeoffice is uploading full clarity for people who are on HSMP and have entered before Nov 2006. This can mean new forms or new exceptions for us.

So he was not sure as to should i fill tier 1 or not, he then asked me wait for 1 week and check what information is being uploaded at homeoffice website.

They have also replied to my email:

-----------------------------------------------------------------------

Dear rajivferroin,

Thank you for your e-mail,

Thank you for your enquiry regarding the recent Judicial Review relating to the

changes to the HSMP extension processes.

What does the ruling mean for those affected in practical terms?

We will offer a remedy for those affected in line with the judgment.

The practicalities will be announced as soon as possible.

But when will you announce the practicalities?

We want to make sure we give the arrangements due consideration so that they

work as smoothly as possible after they are announced. We have interim

measures to deal with individual cases as they arise.

Please refer to our website for announcements regarding this subject,

www.ukba.homeoffice.gov.uk

Tier 1 (General) applications should be submitted up to one month before your Leave to Remain as a Highly Skilled Migrant expires.

Please complete a Tier 1 (General) form, enclosing the appropriate fee (£750) and specified required documents (see the Tier 1 (General) Guidance Notes).

The applicant’s passport and those of any dependants must be sent together with the Tier 1 (General) form in order to be endorsed. A separate Tier 1 (General) Dependant form must also be submitted for each dependant.

It is important that applications are made before your current leave to remain expires.

Applicants will be able to continue working whilst their extension application is being considered provided :-

· They have previous leave granted under the HSMP scheme and their Tier 1 (General) application is submitted before their current leave expires.

The application form and guidance can be downloaded from our website - http://www.bia.homeoffice.gov.uk/workingintheuk.

They are also available by calling our application order line on 0117 344 1471.

HI,

Update of my WP to TIER1 status :

Applied on 11th April
Got reference number on 14th April ( PB3026******)
Called HO on 14th May - Was informed that it is bening looked into by a case worker and after which it would be sent to a Manager who would need to sign it off before it is sent for stamping of Visa .

Wish that they decide ASAP and send the documents .. this wait is extremely painful .

Cheers,

NEED HELP----PASSPORT EXPIRING

Post by bajaj06 » Thu May 15, 2008 12:22 am

Can someone help.....I am in UK on WP and I am going to apply for TIER-1 on 21/05/08 as some of my documents are arriving on 20th....However my passport is expiring in end of july this year.....do you think that makes any difference...coz i've heard that if passport is expiring within 6 months of travel then we are not allowed to travel....does that rule applies to visa application.

Another question....i came to UK on student visa. after finishing studies I got job here and currently I am on work permit.....while filling the Ties-1 form it asks at some point...when did applicant enter UK and also what is visa number....do you think I should give my student visa number and my first entry date of UK or should I give my work permit visa number and that issue that.....I am sure someone else might have had same scenario.....

I have applied on April-08 and my passport was expiring in September-08 I got the approval even though my PP expring less than 6 months.

Other option available is you can get your PP renewed from the your country embassy ( if it is India , then I have seen people getting PP within a week if you apply in person).

I feel anything is ok for your second question. If you check the visa stamp one will be Entry clearance you can enter the number on it.

if it is the application for approval alone then no need to send passport. but now for tier 1 u need to send the passports as well. So I guess its better to extend ur passports before applying. I am not sure if they can give a visa which is valid for longer than the passport.

For your 2nd question i think u have to give the student visa number and the date u first entered. I am sure even if you dont give any thing they will have al your details. so there is no need to lie. It will help if nothing in the application raises doubts.

You can off course get a VISA whose validity is longer than your passport validity.

Update

Post by emacmac » Thu May 15, 2008 10:10 am

Just called again and told "no decision has been made yet".

I asked them if it was to be approved does it have to go through any other processes before the stamp in the passport, but she said no - once approved it will go to the passport processing team and then to dispatch.

My application has been with a caseworker since 1st May, so is starting to get a little frustrating and a little nervous. This makes it 10 working days (well 9 with the bank holiday).

I would have thought this was a fairly straightforward application (i.e. passport from an English speaking country, all education documentation previously submitted on initial HSMP app two years ago, maintenance bank account statements, full 12 months pay slips, P45, bank statements, letter from employers)....

Does anyone have any ideas of the time it takes from caseworker assignment to a decision? I think I read in here for some people it's been a week.....

I can understand your frustration and I guess that's applicable for all who are in the waiting-in period, but this is how HO processes applications.

Anyways, please see below the text excerpt from BIA website about the actual start of consideration date

Application date by post
The date of postage is used as the date of application.

The date of an application made by post is decided by the postmark. The payment handling service attaches the original envelope with all postal applications. If the envelope in which the application was posted is missing, or if the postmark is illegible, the date of posting is taken as at least one day before its receipt. The day of receipt is normally the date the payment handling service processed the fee. If there is any uncertainty, you will be given the benefit of the doubt.

So you need to add 4/6 weeks to your payment date as per their service standards for Tier1(general).

Hope this helps.

Waiting..

Post by emacmac » Thu May 15, 2008 10:59 am

Hi junior

That's useful to know, thanks for putting it up there.

My payment date was 8th April, so hopefully a decision will be made any day now.. Maybe it's 1-2 weeks from assignment to a caseworker?

When I've called for an update they said because it's a new process, there still aren't any service standards identified yet - guess that's the downside of being in the first batch(es) of the new system.

Will cross my fingers for the next week then!

Hi emacmac,

every time I have spoken to the HO CC these are the standard/tailored replies I have got.

1. No Service Standard
2. 4-6 weeks average processing time
3. "Under consideration" or "assigned to a caseworker"

so based on the information on the BIA website, Customer Contact standard replies and from the time lines of those who have got their approvals, I can roughly say that processing times are somewhere like..payment date + 4-6 weeks...This is purely my guess work, though...

All the best to all the wait list applicants.

Last Approval - Application Date 9th April

Post by kmore97 » Fri May 16, 2008 8:46 am

From Abhishek's post, I can see the application date for the latest approval is 9th April. So there has been no approval for application made after 9th april. Today is 16th May - so 1 month and a week is the minimum waiting time for people applied after 1 week of april.

Received documents on 16th May.
Approval details I'll post once I reach home. I havn't seen the docs yet.

Here is application summary:

I am in Uk on WP and applied now to switch to tier 1.
Straight forward case with 80 points claimed(and awarded)
qualification - 30
previous earning - 40
Age - 10

Docs provided

1. BE degree and final semester marksheet for english and for qual. (my qualification is on BIA calculator)

2. 12 months salary slip (stamped and signed) and bank statements (on bank stationary). Also I attached the excel sheet for mapping wach months salary and amount deposited in bank.

3. Also for maintenance funds, I provided multiple accounts. Also I used the transactional arrangements put in place by the HO for maintenance funds. Bank statements and letter from bank on bank stationary.
