5.What would be the best time to start the application process? taking into consideration the permit expiry ( Jan. 2019)

on your UK RC?
If so, you can travel alone to Spain since you will be joining your spouse there.
The rule is: Travel together or travel alone to join
So no need for a visa.

You should have no issues. If you are really worried, go to UK and travel together but you don't really need to do that.
