Help with calculating employee hours for Tier1 to ILR

Help with calculating employee hours for Tier1 to ILR

Dear Members,

I am planning to apply for my ILR in couple of months.I have in total 7 employees out of which 2 employees are full time and the rest are part-time.The following are the no. of hours worked by each employee:-

Employee A- Part time From Dec 2017 till date-5o hrs each month

Employee B- Part time from Jan 2018 to Aug 2018- 85 hrs each month

Employee c- Part time from Jan 2018 to Jan 2019- 80 hrs each month

Employee d- Part time from Feb 2018 till date- 60 hrs each month

Employee e-Part time from Mar 2018 till date-60 hrs each month

Employee f- Full time from June 2018 till date- 130 hrs each month

Employee g- Full time from July 2018 till date- 150 hrs each month

I applied my initial visa before April 2014.So i think i am under transitional arrangements.Considering the above scenario,could anyone tell me the best way to combine the jobs and fulfill the job creation requirements?Any suggestions are most welcome.

You can only benefit from transitional arrangements if you apply before 6th April 2019. In that case all you need is 104 weeks of FT employment min 30 hours a week in any combination of jobs or employees AFTER extension.

Incase you plan to apply after 6th April 2019, then you need 2 FT “JOBS” for 12 months each AFTER extension.

What is your initial visa date?

Thanks tier11417. I got my initial on 28 April 2014.What can be the earliest date to apply for ILR. Also looking at my employee hours, what could be the best combination to satisfy the Job creation requirement? I pay monthly to my employees and hence would like to calculate monthly (Equivalent of 24 months full time requirements)

Looking forward for any more suggestions.

My extension is from 1st dec.2017.So all the jobs mentioned above are after extension.I want to know how the jobs can be combined and what could be the earliest date to apply for ilr.

You qualify under continuous residence from 01/04/19
To benefit from transitional arrangement the latest you can apply is
05/04/19

From the looks of ur stated employment
Job1
Employee F- FT

Job2
Employee G - FT

Approx= 19 months

Job 3
Employee C or D -PT

6 months

Combined with but stated as a seperate job.

Job 4
Employee E - PT
6months

Appr= 6 months

Total= 25 months

Thanks tier11417. All of my jobs start from 1st of mentioned month.Only 2 employees have left at the end of the month.(Last date of that month).So basically the whole months can be calculated while combining the jobs.I hope that makes clearer to get more ideas/suggestions.

Lets say you will apply on 1st April 2019.

One of the combination could be:

Employee F: 1st June 2018 - 31st March 2019 10 FT months

Employee G 1st July 2018 - 31st March 2019 9 months

Total 19 FT months

Combine C & D
1st Feb 2018 - 30th June 2018
5 months FT

Total: 24 FT months

Going on what you’ve stated:
Just list employee C and D as 2 separate jobs (coz you can under TA)
These 2 combined are equivalent to 1 full time Job hours.

Going on what you’ve stated:

Why Feb 18?
Only needs 5 months from PT
June 18 to Jan 19 covers 8 months.
Or am I missing something here..

Sorry got it, actually OP has many options so yes this is a possibility also, rather count June 2018 onwards both C and D. I actually counted PT Feb 2018 onwards.

Dear Members,

Just want to confirm whether we have to send anything else apart from passport copies if an employee is born after 1983? I mean one of my employees is 17 and one is 20.I have got their passport copies.Do i need any other proof of identification for them?

Nobody knows?I hope some of the members must have used the employees of that age to claim job creation.Pl let me know if anybody knows to confirm if i need anything else as one of them will be leaving soon.

Refer to Tier 1 guidance page 33

d) Copies of any of the following documents which demonstrate that each employee has settled status in the UK:
(i) the biometric data page of a British or EEA passport showing the photograph and personal details of the employee;
(ii) a birth certificate, showing the employee was born in the UK and Colonies before 1 January 1983;
(iii) if the employee was born in the UK on or after 1 January 1983, a birth certificate, together with documentation, such as a passport or naturalisation certificate, which confirms one of their parents had settled status in the UK when the employee was born, and additionally, if the parent is the employee’s father, a marriage certificate to the mother;
(iv) if the employee is an EEA national, a UK registration certificate/permanent residence document;
(v) if the employee is the spouse of an EEA national, the biometric data page of their passport, showing their photograph and personal details, or a residence card, and any of the documents in (i) or (iv) above which relate to the EEA national, together with their marriage certificate to the EEA national; or
(vi) If the worker is an overseas national with settled status in the UK, the biometric data page of their passport containing their photograph and personal details, and the pages where a UK Government stamp or an endorsement appear, or a biometrics residence permit, or official documentation from the Home Office which confirms their settled status in the UK.

Thanks tier11417. Also regarding the job creation points,can we list all the jobs created during extension? I haven't gone through the online application yet but want to know if that makes easier for the case worker to count the 12 months requirement?What's your suggestion?

You can claim for all job creation after extension. The rule is you need 104 weeks/24 months of 30 hours/week FT employment. Its all best to send more if you have. As per the rule CW needs to count 24 months or 104 weeks only although its better to send some more to be on the safer side(given you apply before 6th April). If you apply after 6th April, you need 2 FT jobs for 12 months each.

Initial grant: 28/04/14
Ext: Dec 17
5 years for ILR: 28/04/19 minus 28 days
= 01/04/19

If you apply by 5th April 2019:

Job 1: FT
Emp F= June 18 - March 19 payslips
10 months

Job 2: FT
Emp G= July 18 - March 19 payslips
9 months

Job 3: PT
Emp C = June 18- Jan 19 payslips
8 months

Job 4: PT
Emp D OR Emp E= June 18- Jan 19 payslips
8 months.

RTI FPS June 18- March 19

This above will suffice to keep paperwork to the minimum and gives 27 months of employment which is more than required to qualify...

Thanks aman90 and tier11417 for your prompt replies.Yes, as you mentioned, i am thinking to supply all the jobs created after extension as suggested by aman90. But do we have that much space in online application?I need to find out!Also,if for any reason i apply after 6th april, will the above job creation still works?Please let me know if anybody has successfully applied in similar conditions in the past.

Run a dummy application and find out.. if ur applying after 6th April.. it still won’t make much of a difference to you..
The requirement is that the 2 jobs must have lasted at least 12 months.
Employees may come and go..
2 part time JOBs can be combined to equal 1 job provided they lasted 12 months each.. mind you this isn’t 2 employees..
Now use this intelligence to apply this to ur jobs and employees you have.
