spouse visa app under 5 year route but granted 10 year route - what are the options? Not sure why this was done

Post by taffet87 » Sat Sep 19, 2020 11:04 am

A friend applied for spouse visa under 5 year route but gwas granted 10 year route - what are the options?

He and his wife (who is a British citizen) met all the rules.

Please see visa refusal letter pictures (with perosonal details redacted) attached.

What are the options to get this fixed? He had supplied all the evidence for normal route and met all the requirements for the 5 year route.

His Visa application type was "Apply to enter the UK as partner"

The UKVI letter doesn't mention any reason for not giving the 5 year route - does this mean the firend made some sort of error in the application form which led to this?

Advice from experienced members will be appreciated.

I have the pdf of their application form too if that will help

Request a reconsideration. Ask them why D-LTRPT.1.1. had failed.

Thanks will get him to apply for reconsideration.

Is there anything wrong he could have done on the application form that I can check as in ... maybe its a mistake by him in the application form rather than mistake by UKVI (even though evidence of all requirements was provided).

Or is this a not very uncommon UKVI error in your experience?

Also the reocnisderation link says

"Send your request to the team who made the decision on your original application - the address will be shown on the decision letter."

The letter only says "Sheffield Visa Section" so there is no full address.

Does anyone know which precise address to send the reconsideration request to?

Re check the requirements of GEN.3.1 and 3.2 and how it applies to the application vis-a-vis the pdf application form that you said you have. If this is wrong, challenge the decision as soon as possible.

3.1 and 3.2 are completely irrelevant as there is no child and his spouse meetings the minimum income requirement by a large margin

Which postal address or email should a reconsideration letter/email be sent to?

Don't need to do anything as you seems to have been granted the correct visa (Partner Standard). The reverse side of page you are showing is a generic template and doesn't necessarily pointing out towards you. Just wait for the BRP and then act accordingly if it will become necessary.
The opinion expressed as above is neither a professional advice nor contesting/competing to other member's opinion/advice.
