Surrender existing passport

Hi team,
I spoke to Indian High Commission, London regarding the surrender certificate of Indian passport and issuing a travel visa for my kid. They have advised that Surrender and other services none essential service are suspended at the minute. They suggested applying for a Surrender certificate at the local passport office in India and return back on his British passport.
My question is:
1)According to the law I can penalize for this? I asked them to give in writing and the guy disconnected the phone.
2)Secondly, if Indian passport is canceled while coming back Indian Immigration will ask for an Indian Tourist visa.Isn't it? Which you cant apply while in India.
So not sure what to do?
