EU Presettlement to settlement

Post by vegvisir1210 » Sun Apr 11, 2021 11:41 pm

I am married to my husband EU national in 2018 and I have applied for presettlement.
I am curious I have been living together with him before marriage for a year, can I apply for settlement in 2022 instead of 2023? I have seen someone say it's possible, and if so, what document should I prepare for it? thank you!!

It depends. Did you have a RC as unmarried partner?

As far as I know, and as fas as I've seen the rules applied to numerous members here, for any time you want to count towards the 5 years you need to either:

a) have had a EEA RC as the unmarried partner of the EU national throughout that time, or
b) be married to the EU national throughout that time

Or a combination of the above.

So the time after your wedding date should count, but unless you had a RC as the unmarried partner of your now husband before your wedding, then that cohabitation time probably won't count.
My posts express what I believe are the facts, based on the best of my knowledge, about the topics discussed in this forum. They do not constitute immigration advice.
