Tier 1 Dependent ILR

Hi Guys,

Need some help, please.
I found out today that Tier 1 dependents has been removed from the ILR route, is this correct?
My Wife is living in UK since Feb 2014 on PBD dependent, since then we extended her visa twice. Last time in April 2018. She was eligible for her ILR in Feb 2019 but we waited because she had Visa till 2021. Her Visa Expires on the 29th of April (next month). I was planning to get her ILR done under Priority service.

Can someone please advise does the change of rules means she can`t apply for ILR?

Has anyone applied under the same situation and got any positive result?
If she can`t apply for ILR then what she needs to do?

After she was eligible for ILR, there was no requirement to wait.

Which category of Tier 1 were you on?
Were you granted ILR under this category?

If you were in Tier 1 (General), then there are some members in similar situations.

Thanks for replying Vinny.

I was on Tier 1 General, got my ILR on 01-04-2015.
Yes, I was granted ILR under Tier 1 general.

We did her PBS Extention with my ILR back in 2015, Home Office gave her an extension till April 2018. She was not eligible for ILR back in April 2018 because she didn`t meet the 5 year period, so we did one more extension back in 2018. She was granted an extension till 29 April 2021 and we wanted to apply for ILR but delayed it due to Pandemic etc and never thought it would cause any problem.

Doe this new rule now apply for Tier 2 General, Tier 2 ICT aswell?

They preserved the Tier 2 (General) dependant ILR route under the Skilled worker dependant route, etc.

But they seem to have forgotten the Tier 1 (General) and Tier 2 (ICT) dependant ILR routes.

can you please advise, should I apply using set(o)
I saw few other members are in the same situation. Will it be likely to get approved? Her BRP card says PBS dependent on it.

Thanks, Vinny, just to confirm.
We went through the super-priority service today and got the ILR successful email within two hours of biometric.
So nothing changed in terms of rules for Tier 1 General dependents.
