Lost BRP whilst ILR Application Pending

Hi everyone.

I lost my BRP Card - limited leave to remain - and have reported it lost to HO as well. My current LTR is valid until April 2023.

Due to my personal circumstances, I went to ahead and applied for ILR using Super Priority Service so I was expecting a decision on my ILR application within 24hrs, so didn’t apply for replacement, however the HO delayed and have asked for more time to consider the application.

Question is, if it’s okay to apply for BRP Replacement whilst my ILR application is pending?


(Apologies to the mods if this is in a wrong thread).

If ILR is succeeds, then it replaces the lost limited BRP.
If ILR fails, then apply for a replacement BRP?

So they won’t issue a replacement whilst the application is pending? I just really need the BRP at the moment

But, can I apply for replacement or HO won’t issue one?

I don’t think there is anything stopping you except that it becomes superfluous after they grant ILR.

Thinking of applying just in case if god forbid they refuse my ILR, at least I can get my BRP for my current leave in time.

Also, since I did not receive decision from HO within 24hrs and they have asked for more time, I’m wondering if I can get a refund for super priority service fee? If so, if you could please highlight the process to make such request?

No refund if they replied saying your case was complex.

I think their priority service refund policy seems unreasonable if the Rules and Guidances themselves make applications inherently complex and the applicant isn’t at fault?

Yeah it seems I might not be eligible for a refund. So much for super priority service…

I was about to submit my application for BRP Replacement, I’m slightly stuck on the last question.
It asks if I have ‘reported the lost or theft to the police’. Wondering if its absolute must / requirement to do so for someone like me who most likely have misplaced / lost it at home. If someone could please advise on this.
