Spouse visa and English language requirement

Post by rose07 » Tue Apr 26, 2022 10:42 pm

Hi There,
I am on a tier 4 PBS visa and a 4th-year final year PhD student. I want to apply for a family visa because my visa will expire within two months.
I do not have a UK degree ATM, but I did an MPhil degree from Pakistan, OR I can take a bonafide letter from my current UK university (Is that applicable?)

Do I still need Ecctis or NARIC English language letter to prove that my course was in English?

Second, please help me; my husband has ILR. So kindly let me know which category or family route I need to apply.

Many Thanks
rose

Dear Vinny,
Thank you for your kind help.
Please help me with what I understand in the last line of the paragraph where 'if they have already shown.'

(i) the applicant has passed such a test; and
(ii) that test was an English language test in speaking and listening which is approved by the Secretary of State and was taken no more than two years before the date of application and at a test centre approved by the Secretary of State as a Secure English Language Test Centre or if they have already shown they met the requirement in this manner at the level required for their current application, in a previous successful application for entry clearance or permission to stay.

So can I use my university student status letter, which also mentioned that I am a final year PhD student and writing upstage? I did IELTS in 2017, which expired after two years.

Do you suggest for NARIC English proficiency certificate?

I am looking forward to hearing from you soon.

Best Wishes,
Rose

Hi there,
I need your help to apply for a family visa.
my husband has ILR (long residence)

I came to the UK on 21 June 2016 as a student doing PhD from university, and this is the last year to submit my research thesis.
I wanted to apply for a family or partner visa. However, I am not sure which route I need to apply.
Please see below what I did.

I chose the Visa route (FLR) than type (FLR)(M). Is that fine? please confirm

documents list. If anything is missing, please add it for me
1- passport 2-BRP (applicant)
2-Marriage Certificate
3-English language certificate
4-National ID
5- Proof of addresses last two years

Husband Detail. If anything is missing, please add it for me
1-passport 2- ILR
2-Salaries slip (6 months) + Employment Letter+P60
3-Bank Statement (6 months)
4-Proof of addresses last two years
5-Consent form
6- Sponsorship Undertaking (Form SU07/12) Do I need to sign this too?

Do I need to submit a tenancy agreement?

Many Thanks

In the UK
I don’t think you require a sponsorship undertaking.
Probably require a tenancy agreement.

If you don’t satisfy the normal requirements for FLR(M), e.g. £18,600, unless spouse receives eligible benefits, then you need exceptional circumstances.

Thank you very much for your kind help.

One more thing regarding the English language requirement.
According to the See also Evidence of English Language Requirements, in particular, 31.

If you have not been awarded a transcript or degree, you can get an academic reference from the institution awarding the academic qualification inside the UK.

So I have received a letter from my University in which they mentioned the start and end date of the PhD course and all relevant things about the course name etc., but they did not mention when the degree will be awarded.

Is that fine?
Or do I need to go far Ecctis?

Please advice

Hi,
One more thing I need to know
My husband works with NHS 0-hour contract, but his pay is more than £18600.
He got an employment letter in which they mentioned a 0-hour contract also.

Do we need proper contact, or just income has to be more than £18600

Please help me to clarify that point!

Many Thanks

Contract not required. Letter from employer fulfilling the requirements is what's needed.

I do not know the answer to this and don't know the acceptability for your application.
However should it boil down to doing a test, go for the English test at CEFR Level B1.

Thank you for your help and support.

Hello,
Can you please guide me on the below question?

My husband works for NHS, and his P60 has not been updated. However, the HR office said it would update after 30 May 2022. So I have added his HMRC taxable sheet, which I printed online as a replacement for P60.

Is that fine?

Please guide. I want to submit my application this week.

Many Thanks

What requirement are you intending to meet by adding the P60?

Thank you for your reply.

Financial requirements: I added six months' payslips, an employment letter, and a P60. But the replacement of p60, I added HRMC Letter.

Many thanks

You will have to check and see what's available. Check for centres that may not be in your immediate vicinity.

Thank you very much for your help.

Can you please guide me regarding the document submission?

Do I need the same copies of the documents to present the biometric appointment, which I will upload into the portal, or do I need to take the original with me at the appointment?

Many Thanks
