Does my wife still has ILR eligibility?

Post by kali2023 » Mon Mar 13, 2023 9:36 pm

My wife is on Tier-2 dependant and her visa details are as follows

1)VISA1 (BRP VALID: 25-June-2017 to 15-Feb-2020) --> Issued outside UK

a)Entry clearance issued from 08-July-2017 to 07-Aug-2017
b)Arrived in the UK on 15 July 2017
c) Left the UK on 11-Feb-2018 and came back to UK after 10 months on her second visa

2)VISA2(BRP VALID : 03-Dec-2018 to 08-Oct-2021 ) --> Issued outside UK

a)Entry clearance issued from 15-Dec-2018 to 14-Jan-2019
b) Arrived in the UK on 15-Dec-2018
c) she has 1 month's absence on this visa2 in 2019

3)VISA3(21-Oct-2021 to 22-Oct-2024) --Issued in the UK

She left the UK on 09th July 2022 and she has not returned yet.
So as of today, she has more than 10 months of continuous absence on this visa.

Does she still have a chance of being eligible for ILR?

Thank you...

No she cannot apply for ILR as she has been absent for more than 180 days since her last visa was issued. Her 5 year continuity of residence is broken.
