Non-EU Parent of British Citizen with no legal status in UK

Hi

Can a non-EU parent of a British citizen child with no legal status apply for family visa and if so, what type of visa to apply for. Is it the 5 year visa route family visa? Or is the only option asylum route as the relationship has broken down due to domestic violence after living with British partner for two and a half years.

Is the other parent of the British citizen child in the UK? Do they take any responsibility for the child?

Hi,

Yes the other parent is in the UK but the child, few months old is with the parent who needs the visa 24/7. The other parent isn't involved and doesn't support. Would this affect the visa needing parent?
