FLR M TO ILR NOW

Hi All,

My wife is going to apply for her ILR as she has been on FLR M (family route - spouse) for nearly 4.5 years now.
Her 1st FLR M in Jan 2019
2nd Extension in June 2021 & the visa valid till March 2024

We are aiming to apply for her ILR in Feb 2024.

Our questions: that she has been out of UK for 11 months in the year of feb 2022 to Dec 2022.

And we got stuck in aboard (India) during covid from November 2020 to June 2021.

And now we are planning to go to India for a short trip in November for 2 weeks.

Would that be an any issues for being outside of the country this much?

Is there any sort of rule that she has to be inside the UK prior to apply for her ILR?

Time spent outside doesn't matter for ILR SET (M). However, it would be a problem for naturalisation in future.
No sin in failing, you just have to try and try again!

So there is no such time line she spent out side of the UK then?

Also there is no conditions like she has to be in UK for a year or something before applying for her ILR?

whereas, other category visas having rules not staying outside of the country for a certain period of time length?

Summary:

she can stay out of the UK as much as she wanted right? no restrictions?
And when she is appling for naturalisation she has to be maintained her absences, correct?

When shall we apply for her Naturalisation?

I was only worrying for her ILR - there is no issues obtaining her ILR right due to she stayed out of the UK for nearly 500 days during the 5 years in FLR (M)??

Hi All,

My UK history- came here on Tier 2 dependant visa from Feb 2016. switched to spouse visa as my husband got his ILR. therefore, my stay was reset for ILR.

I am preparing for applying ILR from my spouse 5 years route using SET M form

1. I should be using SET(M) form right?

2. First approval of spouse visa from - 03/01/2019 till 17/03/2024. when shall I apply for earliest?
originally 5 years ends on 3 January 2024 from 03/01/2019 - when shall I apply?

3. I was out of UK as below during my 5 years period of spouse visa:
2023 - 35 days
2022 - 309 days
2020-2021 - 213 days
2020 - 6 days
2019 - 28 days
Total days of absence = 591

we both out of the country UK for a while due to our personal circumstance including COVID stuck, would that be ok that we stayed outside quite a while?

4. when should / which date I submit my online application?

5. I was using Naric certificate for English requirements for my previous applications - is that still ok to submit the same documents for the English requirements for the ILR?

I will be asking more questions as I go along while I do my application!!!

2. 60 months after first visa approval- 28 days is the earliest date of ILR eligibility
3. There is no absence limit under the family route. Absences are therefore irrelevant
4. Apply when eligible for ILR
5. NARIC obtained under the RED route, evaluated at B1 can be used

sorry I did not egt the NO:5 answer.

should I do the English Exam or shall I use the same Naric certificates that been used for previous applications?

And how can the abroad certificates be evaluated to B1 level? kindly please guide?

is there any option for Naric UK for ILR applications? sorry I am not getting your answered!

I have checked on my previous Naric was evaluated to C1 level. good to go right? just double checking..

C1 is higher than B1 so yes.

Hi there! there some threads are confusing and dont want to mistake.

kindly please give me a accurate date for applying my ILR please people?

1st granted from inside the UK - FLR (M) spouse visa from 03/01/2019 till 17/03/2024 expiry date.
when shall I apply for my ILR please? shall I submit online at 8th December 2023?

Please please give me a right date - I will apply a couple of day later for a safer side.

Do you own or rent your home?
I chose = Neither own nor rent
Who provides you with accommodation?
I wrote = I and my husband, we both bought the house together in Feb 2023
I confirm I will provide:
Proof of property ownership from the owner of the property you live in, such as a mortgage statement
- Shall I provide deed land registry document for this?
I confirm I will provide:
Copy of an ID document of the owner of the property you live in, such as a passport
- Provisional Licence to this? or what shall we give?
I confirm I will provide:
Letter signed by the owner of the property you live in stating that you have permission to live there
- what sort of cover letter should we provide?

You could simply chose "Own" as that is correct and provide the documents you stated above.
If you go with above own option, there may be no need for such letter, the aspect of your spouse is covered by the joint account verification consent you will give.

A 3 part document will be generated for you to print and sign at the end of application.

when I choose -
I own
How much mortgage do you pay each month? (Required) = 1504 pounds (my husband only pays from his bank account)
If you do not have a mortgage enter 0

Please note: the mortgage on both names though - please advise accordingly!!

Is that be good that I am not sharing paying towards mortgage whereas I pay bills instead from my account and covering expenses - using credit cards and stuff

It's not a problem, enter what hubby pays. The earlier stated consent form covers this

Hi there!! A quick question;

Does Naric (English Assessment) has any validity as I had that 1st spouse visa application from Jan 2019 - is that be ok to use same one?
