Tier 2 Dependent Visa to Indefinite (ILR)

Hi All

Actually I need some suggestions please, I was on tier 2 visa when my spouse came to UK in June 2018 on tier 2 dependent visa for 3 years and she got extension on tier 2 dependent visa in June 2020 for another 3 years till November 2023, in meanwhile I got my indefinite and passport respectively in January 2020, while my wife was still on tier 2 dependent visa.

Now my questions are please, can she apply for indefinite (ILR) now as she has completed her 5 years already or should she wait until her visa expires in November 2023.

She already has passed her English test in April 2023, B1 from Trinity College London and also has passed her life in UK test in August 2023. Are these the only requirements for her to apply for ILR?

If she can apply now, kindly advise as fees are going to be increased in next month October. Also Please share the link of form which we need to fill up for indefinite (ILR) from the route of tier 2 dependent visa.

Yes, she qualifies after 5 years. Her visa expiry is irrelevant. She needs her BRP, LIUK, English language and two years of cohabitation evidence

Thanks Zimba, could you please confirm me in the link which you sent me, which form i need to fill up Set(O) or Set (M) please?

Also, if you can do me more favour please that which kind of cohabitation evidence can there be? if you have any link of list please?

Any evidence can be used for cohabitation. There is no set list.

Hi Guys

One more question please if you be kind enough to guide me. I have completed the form and at the end in consents section: I did yes first 2 and last one no, is it ok or do i need to provide something for point 3 as well please?

. Is the account with a bank or utility company for which you have supplied information and supporting documentation held jointly by you and other people? Yes

. I understand that by ticking this check box I am giving consent to verification checks. I will provide a declaration signed by each of the other joint customers on an account with a bank or utility company?Yes

. Does the account with the bank or utility company for which you have supplied information and supporting documentation relate to another person who is to provide you financial support? No

Also, in required documentation: I understand in below point 1 i need to sign for joint account verification and that is why they put my name, but in 2nd point - declaration is not signed by my wife (applicant)? why they put again my name in it please? i am just wondering if we are putting some information wrong in it.

. Consent form for the Home Office to request verification checks on (my name) for joint accounts or third party support.

. Declaration signed by (my name instead of applicant name) to confirm consent for the Home Office to request verification checks

She signs part one and you sign part two of the consent form. Ignore part 3

Hi All

By the grace of God, my wife has been granted settlement status, you guys have helped us a lot, i really appreciate your time and help.

one quick question please, my wife's biomatric card which we received yesterday, it is valid from 16 Dec 2023 to 31 Dec 2024. my question is, should it not be for 5 years? why home office only sent it for 1 year and 14 days only ? is it the home office's mistake or what?

Your suggestion is appreciated.
