Need to help a friend , please advise

Post by tier2GenBot1 » Sun Sep 24, 2023 11:58 am

HI ,

I am british citizen and my friend is in UK on Student visa , She was studying in Sheffield University and running out of savings . Her course completed and now she is unable to find a suitable job.
She spoke to her Lawyer who said below
if someone you know who is British , sets up a company and keep her on manager position she can get a Visa .
She couldnt tell me which type of Visa this will be , or if there are any more conditions .

Is this legal ? what type of visa could this be .
If this was so simple i am sure this would have been a very popular option , but i have never heard of this so worried .

I really want to help my fiend she is here with her two daughters and single mother .

I would suggest that this lawyer be totally avoided. Incredibly dodgy advice.

What the lawyer has failed to state is that whatever company is 'set up' (and it doesn't have to be a British citizen), would need to apply for a Skilled Worker sponsor licence. Be aware that UKVI is VERY aware of ALL the dubious tactics being used and are clamping down very hard.

Why has she not or can she not apply for the Graduate Route visa? She does not need a confirmed job for this visa as it is not an employer sponsored visa.

Skilled worker or graduate visas are the most popular ways to continue to stay in the U.K. post graduation. The graduate visa is the most flexible as it allows the individual to work in any role and the employer does not need to hold a sponsor licence.

Her university should be guiding / advising your friend on applying for the graduate visa if the university is willing to put her forward.

There is one thing that does somewhat concern me, single students with young children do not readily get granted a student visa unless they can prove care arrangements or provide for paid childcare. This is equally true for the skilled worker visa, don’t know enough about the graduate visa conditions tho. I hope your friend is able to do so at the next stage of her stay.

There are plenty of sponsors out there looking for skilled workers but it is very much is certain employment sectors. Care, IT and hospitality are the big sectors.
