refused for self-employment documents

Post by nishad.zaman » Sat Jan 16, 2010 11:03 am

hi to all,

i need your advice and help on the given topic for my appeal.

The home office says

“You have also supplied as evidence a letter from your accountants showing your income generated from self-employment to be 3976. You have supplied your business accounts to corroborate the letter from your accountants.

• In line with the published guidance, however, we are unable to accept your business accounts as corroborative evidence as it does not include a balance sheet.

We are therefore unable to take into consideration your income of 3976 generated from self-employment.â€

Did you receive any letter from HMRC on the taxes paid?

Did you make yourself payments from business acct to personal acct? Credits to your personal bank acct in the form of salaries, dividends may help.

And then how did you pay yourself?? Is this clear on the P&L and the banking statements. Do you comingle the funds from self employment into your personal account? How do you distinguish what is your business income and then personal income? This is why the HO is getting picky.
To be fair, I think the HO is being a bit too picky with requiring a balance sheet vs profit and loss because I presume they need to know how much you made not if your business is stable per se.
At the end of the day, they offer guidelines on what evidence to provide so it says balance sheet and you gave a P&L, then they can technically say you didn't give us what we wanted and you are denied. If you write the appeal, you can try to say such a distinction is moot because the spirit of the documentation has been fulfilled provided it is clear what you actually made as personal income vs business profit.
Cheers

thanks bro

i got your ground.

i am self employed and no one else is sharing the profit of my business.

when my accountant provided me with the letter and the P & L he reasonably believed that he met all the statutory requirement.

i banked cash 4950 in my pesonal bank account for past 11 month and my profit was 3900.

i think they have been a bit harsh on my case.

any more guidence on hiring a proffessional to represent on my behalf now?

thanks again

If you can answer the questions I posed and clearly demonstrate it, then you can do it yourself and just resubmit. Otherwise, there are plenty of "professional" on here that visit the forums, you just have to be clear on what you want and where it went wrong.
